Hi Gurus,

My friend in USA has a problem, I really have not much idea about USA laws and statuses as I am a Canadian citizen. I just wanted to help him or his wife to come to Canada in case if they lose status in USA, but not sure how ...just thinking about it.

Here is his situation. He is a full time employee on a H1B visa and his wife came 5 years ago as a dependent. They submitted for a mutual divorce and court approved it on August 15th, he also received an approval to his home. But his wife is saying that she can adjust now and re-initiate the marriage or cancel that divorce approval. He is not ready to do it at this moment but may be in future which I don't know his plans.

Both has visa stampings until Nov 15th and 797 petitions for next 2.5 years.

Now my questions are:

1. Does he need to inform USICS about this ? If not is there a problem for him in future ?
2. He got divorce approval on aug 15th, does this mean his wife is OOstatus since then ?
3. Can she stay in USA now ? Can she apply for Canadian visit visa ?
4. Any other suggestions for him / her ??
