Hello all,

I have a few questions and hoping to get answers from you.

I am a Taiwanese currently in Canada on Tourist Visa since July 2013, and plan to leave on Jan 2014. My boyfriend is Canadian and we have been together about 3 years. We both agreed that we should stay with each other longer and see if things go along well so I came to Canada for 5 and half months (Taiwanese don't need to apply for tourist visa, we can (ideally) stay in Canada with our valid passport for 6 months.)

Since I never live with my boyfriend more than one year, we decided Spousal sponsorship is the way to go. As first I was planning to apply for extension of my stay, but we talked to a visa adviser we know and he suggested me to go back to Taiwan first for 1-2 months and having everything done then come back again as a tourist, getting married and then extend my stay while apply for PR.

My questions are:

Will it be hard for me to enter Canada again in a short period of time since I just stayed in Canada for almost 6 months? I was planning to come back again in next March but I am afraid that is too close from my prior visiting.

My boyfriend is working at the moment but he will back to school and starting another three years full time program. Will it be a problem since he is my sponsor once we are getting married?

Also, if I decide to get marry in Dec, 2013 and stay in Taiwan while applying for PR, would it make change or coming back to Canada and stay while applying is a better option?

Any advice or help would be greatly appreciated! And thanks for your time :)

Why did this visa adviser tell you to leave? There is no reason why you have to leave and I suggest you don't take any more advice from this person. You can extend your visitor status, complete the application and stay in Canada while the app processes. With a 3 year relationship, you guys should have no issues. Hong Kong is a quick office, posted time is 9 months but most apps are approved quicker than that.

If you decide to go to Taiwan, as a visa-exempt person, it should be fine for you to come back to Canada but entry is never guaranteed.

There is no financial requirement for spousal sponsorship, so even students or unemployed people can sponsor their partners. You guys need to be able to show that you can support yourselves without welfare. This can be shown through a combination of savings, your income, family support, etc.

Provided you guys can afford for you to be here for several months without being able to work, I suggest you just stay here throughout the process and be together. Where you are in the world won't have any effect on the processing.

My mistake on confusing you that he suggested me to leave first. He didn't ask me to leave but he thought it would be fine that I go back and stay with my family first since I won't go back anytime soon after this. However as you mentioned consider entry is not guaranteed that makes me worry if anything would happen after.
