Hi, we were wondering if someone here would know the answers we're seeking as we can't find it online anywhere. We did search the forum here but haven't found something that meets what we're inquiring about.

I'm sponsoring my husband (US citizen). Our application was received in October last year and is still being processed at this time.

Without going into detail that we don't want to discuss on an open forum such as this ... we have been going through our finances at looking ahead into the future and have come to the conclusion that financially it is more beneficial for us to spend 6 months here in Canada and 6 months in the US.

We were wondering what happens after one submits the application for withdrawing. We know that we will get our money back. But what about how long he can stay here in Canada until he has to return to the States? And will is there a restriction on when he can come back for a visit?

Typically the application is withdrawn in a few weeks.

Out of curiosity, do you plan to spend 6 months in Canada and 6 months in the US on an going basis? If so, how do you plan to do that without PR?

I did find out that the application is withdrawn in a few weeks. I wasn't asking that. I was asking how much time would he be allowed to stay once it's withdrawn and is there a restriction on him coming back to visit Canada, other than the usual 6 months that US citizens are allowed to stay here.

How long has he been here already? When did he last enter Canada or what was the last extension to his visitor status that he recieved?
 
He's been here since August last year. That's when he last enter Canada. Our application was received October last year. There was no extention to his visitor status as we were told by immigration that we didn't need to do that.

Did he include an open work permit with the inland sponsorship application? Does he hold a valid OWP now?

You will not get any fees back from the withdrawal apart from the RPRF, if you pre-paid that, and maybe the OWP fee.

Yes he did and no he doesn't hold a valid one right now as we're still waiting for that to be approved too.

I understand what money will be refunded. I'm not asking about that. I'm asking about times ... if he does withdraw the PR how much time might he have before he has to return back to the States. Does he have to go back right away? Or does he have 6 months or less? And when he does go back, does he have a waiting period to be able to come back to Canada as a visitor?

That's odd the OWP is taking that long given your application was received in October. You should have received the OWP in Feb.

Anyway - by withdrawing the entire application, he'll end up being out of status in Canada effective six months after he entered Canada (so out of status in Canada since mid Feb). This assumes he was given the full six month visit on entry and not a shorter visit (as sometimes happens). You should apply to restore his status (application need to be received within 90 days of him going out of status - so you have until sometime in May).

If you withdraw the application - that puts him in Canada illegally / without status since sometime in Feb (count six months from the time he entered Canada assuming he was given the full six months on entry).
