Hello!

I tried to find an answer on the Immigration Canada website, but did not find anything that is related to my case.

My partner and I submitted application for PR in January 2020 (Express Entry - Canadian Experience class, I am the primary applicant). My PGWP expires in April 2020, partner has an employer-specific work permit (based on LMIA) until 2022. My question is: can we both apply for BOWP in one application? My partner needs to get an open work permit as he is no longer willing to stay with the employer stated on his work permit.

We were trying to submit the application online, but when my partner tried to upload Imm5710 form, the following error popped up: "your status expiry date in the answer you provided previously does not corresopnd to the Restoration in your form". Trying to figure out what is wrong here. My Imm5710 form was uploaded just fine.

1) Only the Principal Applicant is eligible for a BOWP. A spouse may be eligible for a dependent open work permit. You can submit the two applications at the same time. If the BOWP is rejected or refused, so too will be the spouse´s OWP. Your spouse cannot change jobs unless/until a new work permit is received.

Generally, IRCC only accepts applications to extend/change work permits within 4 months of the expiry of the permit, so I am uncertain whether they will approve your spouse´s application.

2) If your spouse currently has a permit, there is no need for "restoration" so make sure that there are no errors to questions about restoration...
