Hello there!

I would just like to ask for your expert opinion in this matter. We were just recently approved for a PR under live-in caregiver program. I am already married with one child but my mother was still able to sponsor me because I'm still a student. I'm just wondering if it's possible for my husband to apply for a visitor visa to accompany us when travelling to Canada then he'll just have to go back when I apply for a PR for him?

It doesn't matter that you are still a student. Since you are married, you are no longer your mother's dependent and cannot qualify for PR as part of her application. CIC only approved you for PR because they do not know you are married. If you go ahead and use the PR visa, you will be committing misrepresentation (lying and committing an immigration crime) by landing as a single person when you are in fact married. This means you will NEVER be able to sponsor your husband or child for PR. Additionally, if CIC finds out about the misrepresentation, you can expect that your PR status will be revoked. Don't use the PR visa you have been granted. You are not entitled to it and using it will mess up your life permanently.

Thank you for your reply. CIC knows that I'm married because I'm already using my husband's last name and my mother was also able to sponsor my child. My child is coming with me. I am within the age limit and got married before that. My mother was able to confirm that with CIC before applying so I don't think that's misrepresentation.
 
hencho you're setting yourself up for a world of hurt.

In order for your mom to sponsor you, one of the requirements is you cannot be married. You and your child probably got the visa because CIC assumed you were still single. Your mother was able to "confirm" that you were still eligible with CIC, you said. Either the agent gave wrong information, or your mother misinterpreted it.

DO NOT land in Canada with this visa. Refuse it, immigrate to Canada through a different stream. Living illegally in Canada is an extremely terrifying way to live your life here, especially with your child.
