Question for Windsor-Detroit commuters - US Payroll

hi,

Those of you who live in Canada and work in US, do you have Canadian address on your payroll and W2?
If yes, did your company need to be registered in Canada and deduct Canadian taxes in this case?

1. Yes, Canadian address in paystub, W2, I-129 filing. I get my W2 to Canadian address from US, yearly.
2. No. What i see is that the payroll system just doesnt consider the residence address to deduct any taxes, rather it uses the company location for deducting state taxes. These deductions are of based on tax agreements. I think that, per agreement, US employers are only obligated to deduct local and federal taxes hence they just deduct and left it to us to pay the rest of the taxes in Canada(if one resides in Canada). Its same case for inter state workers in the US - i dont see much difference.

Doesnt matter if they deduct or we pay CRA. All it(CRA) needs is tax - they dont care if employer pays or individual pays.

From a H1 perspective, did you have to make any LCA or H1 amendments for change in your residence address to Canada? I believe, before your move, your address was given as your US address in the H1 application?

From a H1 perspective, did you have to make any LCA or H1 amendments for change in your residence address to Canada? I believe, before your move, your address was given as your US address in the H1 application?
Rule on H1: Residence location should be within normal commutable distance. This is applicable even if the candidates resides in US.
So having windsor as residence location and detroit as work location is not a problem in H1 extension. My case is like this and no issues extending my I94.
As my work location did not change, we did not need to amend after my residence move to Canada. For residence address change, my lawyer might have filed just AR11 form.

The following was stated in an email from my immigration attorney: "Foreign nationals residing in the United States are required by law to complete and submit Form AR-11, Alien’s Change of Address Card (“AR-11”) to USCIS any time their residential address in the United States changes. Completion of the AR-11 is only required for a U.S. address change."

@harirajmohan I see that yours is a simple case. Good that everything worked out without much interruption or complication. The fact that your company is also providing Canadian insurance shows that such cases are normal in your company.

Mine is a little different. My company is 3.5 hrs away from the border. I either have to commute on a weekly basis or work remotely most of the time and come only a couple of times a month or week. I will have to do a little more research I guess about paycheck, taxes and H1. Thanks very much for the info you provided :)
