I have been in Canada for 2.5 years working on a work visa. I seporated from my past company and have been recruited by a new company. I went onto the website and applied for a change to my work visa for the new job. In reading and reviewing information I am not sure if I am able to start the new job under "implied status" or if I have to wait for the approval. My previous employeer took care of all of this for me so I have no knowledge of the system or what is required. I know that when I needed to extend my first work visa I was able to work once the paperwork was filed under the "implied status".

background - I am a senior level manager with a specialty skill set. I was recruited to work for my last company based on this and they did obtain an LMO for that job.

Any info would be helpful. Trying to navigate this process is quite complex.

No - you certainly cannot start your new job now. Since you have a closed work permit, you can only legally work for your last / first employer.

You will have to wait until your new work permit is issued before you will be able to start working for your new employer.

You cannot work for a new employer under implied status. Also, I assume your new employer obtained an approved LMIA before you applied for your new work permit.

I do not think they obtained a approved LMIA. If they did not what happens? Like I said I am a virgin at this and there is a ton of confussing informaiton out there.

Thanks for the reply

You would know if your new employer had obtained an LMIA since you would have included the LMIA reference number when you applied for the new work permit. If you want to work for a new employer, you can't just "change the conditions" on your existing work permit - you have to apply for a brand new work permit tied to your new employer. If your new employer doesn't have an approved LMIA, your work permit application is going to be refused.
