Question About Inland Sponsorship of Foreign Spouse

Hi CanadaVisa forums. Let me first thank you all for having this treasure trove of info - it is so much more useful than the paltry tidbits on offer at the official website.

Basically, I am an international student. I have two years left on my Study Permit. I am in a relationship with a Canadian individual. If we were to get married, say, in a year and then apply for inland spousal sponsorship, then would I be allowed to stay here after the expiry of my study permit? I understand that the application takes at least 16 months, sometimes longer, so what legal means would I have to stay here after the expiration of my current status [since I am set to graduate just as my study permit expires so I don't think I have any means to extend that].

Hi Otaku, You'd be surprise on how confusing and many ways to go about your situation that you will probably learn as you keep on going with your plan to apply and read more posts. (trust me I've been there.lol)

First of all I believe you will be allowed to apply for a Post gradate work permit. To help you attain necessary work experiences to be able to apply for PR on your own. The validity of this permit will depend on how long your course is and I believe will have a maximum validity of 3 years. more details here. http://www.cic.gc.ca/english/study/work-postgrad.asp

Getting married in a year, your partner can sponsor you as soon as you guys complete the paper works needed especially have the marriage certificate.
You can include a Open work permit application with the Pr/Sponsorship application BUT they will only process the work permit part once your Pr/spons application has reached or passed phase I or what they call Approval in Principle, Which currently will take up to 8 months. If your student permit expires while all this is still in process and you have not had the approval I believe you will be on implied status, but it will only be as a temporary resident(visitor) meaning you can't do anything, not allowed to work or study.

So like I said there's a lot of ways to go. It's up to you what road to take.lol
