Hi all,

I am currently in an awkward situation. My PGWP expires at June 27, 2016. My EE score is 443, and I am waiting for OINP AOR/nomination at the moment. My OINP was received by Ontario on Jan 5th, 2016. Given the current speed of AOR for OINP, I am not sure if I can get my nomination (or even AOR) before the expiration of my current PGWP. I have a permanent job at a big company, and the HR is able to get me a letter of employment saying "intent to permanently employ (my name) on a regular full-time basis pending finalization of his Permanent Residence application".

In this situation, can I send a paper application with these supporting document and a letter of explanation of the current situation? Is it possible that I can still work after June 27th?

Is it useful if I write to Ontario explaining all these stuff so that they can speed up the nomination?

The worst case is my BOWP got rejected, and I have to restore visitor record. In this case, can my company "transfer" me to a Chinese branch (I'm Chinese, and my company has a number of branches in China), and "send" me to Canada on "travel"?

I do have an alternative, which is marry my GF who is already a PR. Will this be a better approach?

Any help and suggestion is greatly appreciated, thanks in advance.

1. That letter from your company would be useless. Your company need to apply for LMIA to support your PR application. In that case it would cost nothing to the company. IRCC is pretty strict when it comes to the rules for giving residency permit.
2. You can send a paper application and if it is not finalized before June 27th, you would be able to work some time on implied status until your application is finalized (read refused). It will give you few weeks to work but will not resolve your situation.
3. Worth try to ask Ontario to speed up the process but I would not count on this as I never heard that they were doing it just because someone's WP is going to expire. That's not the reason for speed up application processing.
4. Ask your company if they can relocate you to the Canadian branch. In that case you don't need LMIA.
5. Family PR application would take longer to process (26 months currently) but you might be able to apply for work permit while your application is in proccess as long as you have valid status in Canada (not sure about this - check in the Family class forum).
 
Hi, you can't apply for a BOWP without ITA as you need to submit an AOR received from submitting a PR application in order for your BOWP to be approved.
 
Thanks for all the replies guys. I heard people saying send an paper application of BOWP and explain the situation, then send them the ITA or nomination certification when you receive them. Unfortunately my company does not provide LMIA.

I am working in the Canadian branch right now, so if they relocate me to Chinese branch and can they relocate me back without working permit? I don't think so.
 
Also, can I merry my GF just to get a spouse work permit, but I still go through the nomination and express entry for PR? Thanks guys.

No, it will not work that way. You may apply for BOWP without ITA. It will take some time until IRCC will start processing your application (current application processing time is ~3 months). But at the time IRCC starts processing your BOWP application, your PR application must already be submitted and pass R10 completeness check or else your BOWP application will be refused for sure. IRCC dosn't make exceptions.

You can't marry just to get work permit. You need to apply for Family class PR application to be eligible for work permit. But, I think, you can have two application in process (EE and Family class).

Hi,would you please share what you did and if it worked out? I'm in the same situation as yours. Work permit is expiring on June 30, still no ITA, really want to know how to keep the status in Canada

Yes, as long as you inform RICC later, through its webform that you got your AOR.
