Hi everyone so long story short,
I applied for Spousal sponsorship on Aug 30 2019 with my wife living in Toronto attending u of toronto and I being In Guelph Ontario. We specified that we don’t live together yet but we’re still together most of the time for which we provided evidence ie letter from landlord and Friends stating we are together at least 3 days a week we constantly do nightstays so all this was declared in the application because we wanted to make it as truthful as we could My wife stays with me and sometimes I stay with her and we go to hotels too
So after almost 10 months I got this email stating that my wife is eligible to sponsor me and another E mail saying that I need to provide more proof of relationship and cohabitation, we have been married for almost 2 years and we provided ircc with lots of proofs like pictures, messages, letters and life insurance docs but still they need more proof my question here is that not living together could be a red flag for our application.?

What could be done here ? i don’t understand why would we get that email ?
some help here would be really appreciated.

Did you apply inland or outland?

If you applied inland, it's mandatory that you be living together.
 
We applied inland.. what are the options mow ?

They are basically giving you the opportunity to prove cohabitation and that you meet the requirements to be sponsored. If they are not satisfied with the evidence you provide then they will most likely move to refuse the application.

I'm not sure what to suggest. You technically have two different addresses and technically do not meet the cohabitation requirement.

I would send more evidence of the time you are spending living together and hope this is somehow accepted.

You may have to reapply outland.

Only a personal opinion: move as much as both of you can to one address, including consolidating mailing addresses, etc. And write honestly and explain the situation that your spouse is commuting from Guelph to Toronto while she completes her studies, with as much time in Guelph as possible, but due to the requirements of her study program, she overnights in Toronto when necessary. (Note if the reverse is better, show that).

Note: do not lie. But show that she is in Guelph with you whenever feasible, and that her apartment (or whatever) in Toronto is for overnighting. And that when she cannot, you often go to Toronto. If this means that in the near term she needs to change her time in guelph (or vice versa), do it and show it.

A fair number of people commute from Guelph to Toronto (and vice versa). So this is not unheard of, particularly if one spouse is working and the other studying or has a more flexible schedule. If your own work requires you to travel, then note that those days apart are normal work requirements.

I do not believe they have a hard and fast "rule" for how many days a week or a month or whatever is considered living together. Seven days a week is indisputable, five days a week is better than three, etc. Be truthful and explain. (And back up with documentation where you can, including changing official mailing addresses etc)

I'm not saying this is a lock as you should have been living together (full stop), but it's possible they will give consideration for studies and the situation.

Thank you so much for your reply, we are really getting stressed out due to the email and honestly we can provide a lot of evidence but my main concern is cohabitation sometimes you cant do anything and have to go with the flow with studies and work and hopefully IRCC understands that.

If you could go back in time, then the right course of action would have been to apply for PR through the outland process. Cohabitation is not mandatory to meet the requriements of this program and this is the option provided by IRCC if you cannot live together.

But you obviously can't go back in time. Provide as much evidence as you can and hope for the best.

It could be sent for a couple of reasons either they think the marriage isn’t genuine and are giving you the opportunity to address their concerns. It’s kind of good news because they didn’t reject your application after receiving the pfl letter. Good luck.

Did you receive this email after responding to the 'provide evidence of cohabitation' request? In their email to your response, did they refer to your response, i.e. any indication that they reacted to your explanation about cohabitation?
