Hello. My husbund and i got married in Brazil but he wasnt present in the cerimony, wich was made by procuration. It makes me inelegible to immigrate by the spouse sponsor ship family class. Recently i found the Humanity and Compassion considerations, and I am wondering if I can proof why he couldnt be there for the cerimony and also that he was there to start the process, sign the first papers, etc, it can work for us? Someone pass throw it?
I apriciate any comment... tks
 
What humanitarian and compassionate reasons do you have? Is your partner (not husband in Canada, as you aren't married) unable to travel to Brazil, and you unable to travel to Canada?

That would not be a H&C case. H&C cases are for people already in Canada, that would face some danger or incredible hardship if they were to return to their home country.

Why couldn't you get married in person?? This is probably your only option to be sponsored for PR.
 
I am in canada already, and the marriage was celebrate in Brazil in january. He had to work (we have a letter from work) so he came back to QC. We started the papers while he was there, as soon as he landed, but it was a big burocracy and we hadnt time to celebrate toghether. Thats our Reason. We had pictures of everything. Thats a good reason to invoke the H&C?

If you're both in Canada now, just get married (legally and in person) here. This should be very simple.

You really have no other options. Work reasons will be completely irrelevant and ignored by IRCC. H&C app is practically guaranteed to be rejected.

That's not a reason at all.

You should just get married (with both of you there) if you want sponsorship.
 
People seem to want to make their lives more complicated and not look for an easy solution. Could have also married in Brazil before your husband had to return to work even if it was just a small civil ceremony and then had the big party.
 
We try to do in Brazil, but it takes more time then usual, was Christmans and New years eve holydays.. Anyway.
I search for marriage here, and we need to be single to .have the lic

Cause we married in Brazil where is legal marriage by procuration, all my documents has his last name, inlcuding passport.
It can be some problem to marry here again?
