Hey everyone!

My fiancee (Canadian) and I have decided that it is best that I migrate to Canada instead - for a variety reasons. She has kids there and also I was more healthy (and happier) in my time up there than in the US. I am trying to understand the procedural ins and outs as we have a plan but not sure it will cause any complications. I am a skilled IT worker (Sr software dev manager/tech manager/agile coach) with a masters degree.

I have a couple procedural questions:

1) Am I able to go find work up there with a temp work visa and then subsequently file a spousal visa? Would that be allowed?

2) Am I allowed to be there in a tourist visa to visit the fiancee while we sort arrangements out and remote work with my current employer while I try to find work so that I can be local for interviews?

3) At what point am I allowed to bring my 3 dogs (cocker spaniels) with their paperwork? With the temp work visa/temp residency or the perm residency only?

1. If you qualify for a work visa, sure.

2. You're allowed to visit on a tourist visa. You're not allowed to move. You should also be very careful trying to find work without a work permit.

3. As long as it doesn't look like you're moving to Canada, any time.

The catch is that without PR, you cannot 'move' to Canada. Showing up at the border with your belongings and three dogs makes it look like you're moving.

Temporary work permits can be hard to qualify for - you'd have to see under what category you would get one.

1. you can apply for an open work permit together with your sponsorship PR application. cos in Canada any type of work permit will need a " ground ", and in your case it will be an on-going PR application .

2. if you are an US citizen you don't need a visa to come to Canada. and you mean you want to work in Canada for an employer outside the country ? if that's what you are asking I don't see that as a problem.

3. you can bring in your dogs with you now , don't need a PR status to have pets in Canada , as long as you got the proper paperwork .

Wouldnt you need a job offer for a work permit?

no, not necessarily . if you submit an application for common law or spouse sponsorship PR than you can apply for an open work permit at the same time , and you don't need an existing job offer to apply for that .

There are many kinds of work permits.

If you're thinking about a job offer for a work permit, it either has to be NAFTA-qualified OR you have to get an LMIA, which can take months and months - and then the OWP from an inland sponsorship would be issued faster.

Do you know how long it normally takes to acquire a OWP while the spousal sponsorship is pending? It sounds like that is the best option for us at the moment.

Four months.
