I am Canadian permanent resident. I came to Pakistan for marriage. Now I want to apply for my wife immigration. Problem I am facing is that my wife is previously married with some Canadian citizen and applied under family class in 2007 but she get refused because relationship didn't work. Now I want to apply and I didn't have her previous Canadian embassy record. On top of that her previous file have her different date of birth in Canadian embassy as I have in her documents. This because her previous spouse changed her DOB. Now my question is that should I mentioned that she is previously refused when applying or its OK to go like that. Any other suggestion that can help for the application.
 
i think it's better to be honest and say she got refused and why...only from her name they can find all the info they want abt her before..also she needs to say abt her past relationship, show proof of her divorce (otherwise her marriage to u is not legal); also, maybe they will find weird why she declared 2 different birthdays, make sure u have enough documentation and explanation for that

i'm not expert into this but from my point of view never lie to them; if they find out misrepresentation is a very serious offense (read the guides)
 
oooh and also since u r still a PR and they have evidence that u lied in the application u could get deported...so, be honest

You could order a copy of the file with an Access to Information request. The full file would take about 4 months to get. The CAIPS notes would take approximately 5 weeks. See here: http://www.cic.gc.ca/english/department/atip/index.asp

Identify and address this issue up front. The VO WILL become aware of it, whether you tell them or not. Expect extra scrutiny. Prepare an application with LOTS of proof of the genuineness of your relationship. You may need some legal advice.

Methinks that the OP should be prepared for a verrrry long processing time, with a previous application refusal for sponsored spouse. The OP didn't lie, but his spouse probably did on her application is the birth date is different from her actual DOB. She signed the application and can't blame anyone else.
 
Well prepare for a very long processing time
once married before, wrong date of birth, refusal...all red flag

PLUS!!!!!!! Her first marriage was in 2007 and now she is married again 2010/2011. Pretty much very early for a second marriage.

That is gonna raise some questions.


And you said you went to pakistan to get married...so is this an arranged marriage?

given the cultural norms in pakistan, the Visa officer will be wondering how come you are marrying a divorcee in an arranged marriage. I know there is a whole big hulbahula with virgin brides..not so?

Yep! Hope he loves her a lot because this one isn't gonna be easy.

sorry i formulated wrong; i did not mean that he lied; i meant in case they would not declare her previous divorce; but i guess if she does not declare it, it's not his fault; anyway from what i read in the guides is that misrepresentation is very serious and the PR sponsors could risk even deportation; it's also the sponsor's responsibility to make sure the applicant understands and fills in the forms correctly (also something i read in the guides)

as for different birthdays this is tricky; in some places they don't issue birth certificates at all in others they could issue at the person's request and maybe that person is already 20 years old; so maybe they remember the year when they were born but not the exact date...also, maybe in her previous application her ex-husband was representing her, it happens; still, whatever the case is, u need a very strong argument for CIC
 
thank you guys for valuable advices. Link about extracting information really helpful for me. And fortunately DOB matches with all documents. Also other particular documents to strong applications except mentioned in the forms.
