My brother is a Canadian PR but is currently not given clearance to work due to his medical condition. His wife is currently pregnant but is still working at the moment. He stays at home to take care of his 2 other children but he needs urgent help to take care of them now due to his condition.

Currently, I am in the Express Entry pool with a CRS below 400. Is there a way for my brother to invite me so I can assist and take care of his children (through special case under family sponsorship)? And also get a work permit to support myself and family expenses?

Appreciate any advice.

No - he cannot sponsor you through family sponsorship. A special case will not be accepted.

If you want to care for his children, you would have to come on a caregiver work permit. To come on a caregiver work permit, your brother must have sufficient income to pay your salary as well as cover all of his expenses. He must also have a house big enough to accommodate you in a separate room. Additionally, you must show that you meet the caregiver requirements either through paid work experience or education. Have you worked as a caregiver to children previously?

If you come on a caregiver work permit, you would only be allowed to work for your brother and he is the one who would have to pay your salary. There is no other job you would be allowed to take.

I have read through articles in cic and found he can only sponsor parents (both senior citizens but can still take care of children) but since my brother is on medical leave, it seems rather difficult to prove he could sustain for either or both to come.

Correct. He can sponsor his parent. However in order to do so, he must meet specific income requirements for three years in a row from a job in Canada. For the size of his family and the parents he wants to sponsor, this means he must have earned around $86,000 in each of the last three years. He and his wife can combine their income to reach this requirement. Does his wife have a salary of at least $86K? Have they met the income requirement from jobs in Canada for the last three years?

Also, only a limited number of parent sponsorship applications are accepted each year and the cap has been reached for this year. He would have to wait until the start of next year and hope he is selected from the pool (there are always far more people wanting to sponsor than spots available). If he is selected from the pool, it will take at least a year, quite possibly more, for the application to be processed. So best case scenario, it would probably be two years before his parents could come here.
