Hi Sir
I’m a PR of Canada science OCT 2010 and its valid till OCT 2015, I’m living now outside Canada because I planned to try to find a job before going to Canada in the first two years of my five years but unfortunately I couldn’t find any ,then I planned to go this summer (Before OCT 2013) to spend the last two years out of the five then renew my PR then continue for the citizenship(Passport).
Unfortunately I got a very serious disease (Hepa C) and I started following up with the Doctor since august 2011 and started the treatment January 2012 for 72 weeks (a year and half) and I need at least 6 months after the treatment for monitoring.

This means that I can’t go to Canada this summer and I’m only able to go 2014 summer which means that I’ll stay only for one year out of the five(the last year).
So I need to know
what to do to extend my PR ?
Can I do this while I’m outside Canada?
can I do this now? Or I can extend it when I’ll be there (2014)
note we are a family of five myself, my wife and three kids one of them born in Canada and he got the passport (4 PR + 1 Canadian Passport)
thanks a lot for your advice

You realize that you can also get medical treatment in Canada, at least as long as you go to some province except Ontario, BC or Quebec where you would have a 3 month wait to get health care.

If you insist on staying back home until you are unable to meet the residency obligation, you take the risk that the immigration officer could report you on entry and you would have to appeal for your PR. You can claim your illness as the cause of your not having been able to meet the residency obligation but they could say that there are doctors in Canada too. If you get into Canada without being reported, you would simply let your PR card expire and not try to renew it until you have spent a full 2 years.

Thanks a lot Leon for your fast replay and great advice this will change my family life

· If they don’t report me is it 100% sure that I can renew my PR after I complete 730 days?
· And how long it takes to renew the PR?
· And after the expiry of my PR is it ok with the schools , health insurance and other stuff till I renew my PR ?
· If they reported me I’ll appeal for my PR so what is the % of success and how long it takes ?
· my Canadian son will not support in that case ?

I’m now in the middle of the treatment this means I can’t go till I finish the treatment because I have to take a daily pills and weekly injections and they give it to me on a weekly base and I have to do blood test every 2 weeks to month , and its under my insurance (toll free) so it’s not easy to continue the treatment in Canada so I have to stay here

thanks again for your support

If you get in without being reported, under the current rules, they only look at the past 5 years when you apply so if you stay 730 days and then apply, they see you meet the residency obligation and renew your PR card. Renewing the PR card can take from 3 months up to a couple of years if you are unlucky and they pick you out for an interview and further proof of staying in Canada.

After the expiry of your PR card, you should be fine as long as you stay in Canada.

If they report you and you must appeal, nobody can tell you the % of success. You have an excuse that you were under medical treatment. Like I said before, immigration can say this is not a good excuse because you could have had treatment in Canada. Your wife will likely also be reported if you were but she was not under medical treatment so she could have returned to Canada without you.

Your Canadian son is a minor child and can not sponsor you for a new PR until he is 18 and has income. Having a child in Canada gets you no points from immigration.

Thanks a lot Leon for your replay i have only one more question
PR can be extented before expiry ?
or its only renewed after expiry when we spend 730 days in the last 5 years

No - PR cannot be extended before expiry. The only option is to renew once you have 730 days of residency in the last 5 years.
