Hi everyone,

So I applied for the Canadian PR through express entry on the 4th September and unfortunately received a letter last night to say it was refused as I only have 11 months canadian work experience in the last 3 year period. (minimum requirement is 12 months!)

So a bit of background- I set up my profile on 4th May and sent my documents to WES, i didn't hear anything until 6 weeks later when they said the documents needed to be resent. i did this immediately and got my final evaluation on 19th August. I scheduled the medical and had all my fees paid and required documentation submitted by 4th September (2 weeks after WES had completed!!)

I left canada originally in July 2017- so with the submission on 4th September 2019, I am 1 month shy of meeting the requirements, although i intended to submit MUCH earlier! Has anyone every had an experience like this or know who to contact? Unfortunately reapplying isn't an option as the 12 month experience will be even less now :(

Are the likely to consider the delay with WES seeing as I am a mere 4 days shy of the requirement?

My current job is trying to structure a transfer to their canadian office and my partner has secured his 2 year visa too so ANY ADVICE IS WELCOME!!!

IRCC won't consider the delay with WES. It's your responsibility to ensure this these types of processes are kicked off in advance and the documents available in time. WES is supposed to be completed before you set up your EE profile.

It sounds like you submitted your application on September 4th. When did you receive ITA? What date in July 2017 did you leave Canada?

I think you're out of luck with the refused application and will need to qualify again and reapply.

Thanks for your help! So ITA was 20th August once WES came back.. I left canada on 19th July 2017 so I think if I had submitted 5 days earlier on the 31st August 2019 it would count for the full 12 months..

such a shame to be missing out because of 4 days when I tried to get the ball rolling much earlier in the year! :(

Maybe pursuing an internal transfer with work and getting them to sponsor the visa is the only way!

I'm not sure I understand your logic about the 4 days. Everything is based on when you get ITA (not when you submit your complete application). You received ITA on August 20th 2019. At that time, you no longer had 1 year of Canadian work experience within the last 3 years. You left July 19th, 2017 - so that would mean you were a full month short of having enough work experience to meet the 1 year requirement (not just a few days).

I don't see any grounds for an appeal. If I've understood your dates, you fell well short of the 1 year requirement
