Dear All,

Just a query about my PR status:

- I got my PR in May 2010. (landed Mid May 2010)
- Since then I have been to Canada several times which come to a total of 40 days.
- I'm currently living in the UK and planning to move to Canada permanently by the end of March 2013.

- Do you think that the immigration in the airport would question my stay outside Canada for a long time? (I was last in Canada in June 2012).
- I am aware of the 2 out of 5 years rule but still a bit concerned as by the time I am planning to move (March 2013) I will have only 2 years and 2 months left in my PR plus the 40 days I spent in Canada before.

Your opinions are much appreciated.

To maintain your PR status you must meet the Residence Obligation of 730 days in the 5 years prior to the Residency Determination (those with PR status over 5 years) or be able to meet it for those with PR status less than 5 years. Each time you deal with CBSA/ CIC then a de-facto residency determination is carried out e.g. when at the airport CBSA agent will check you meet the RO. Most PRs with a valid PR Card are usually admitted without any issues/ questioning. Depends on who you find at the border on the day. You will be ok..having the 2/3 month buffer is useful. You should keep records of your presence in Canada as you will need thsi at PR renewal..CIC seem keen on notice of tax assessments as 'solid' evidence of residence in Canada.

I have a similar issue. My immigration has just been approved for me and my family. The medicals were done on the 2nd Nov 2012 we therefore have to land in Canada before 2nd Nov 2013. My children have end of year exams then and we would like them to complete the school year. We live in New Zealand. Can we get new medicals and have the landing date extended to Jan 2014 or is it better to land before Nov 2013 and return to NZ and then come back to Canada in Jan 2014? This is obviously very expensive on flights as I have four children. Any advice would be appreciated.
 
They generally do not extend PR visas so you should land before your visas expire.

It is up to you if you then want to go back and let your kids complete the school year in NZ but I don't think I would put too much emphasis on that. The school year in Canada is from Sept. 1st to June 30th and therefore your kids would be starting mid-year if they arrive in January. It might be better for them if you arrive in July and give them the chance to settle in their new home and make some friends before school starts in September.

1. How much have you spent on the process to date to get your PR visas?

2. How much are the tickets to land and return back?

Compare 1 and 2 - add in the fact that you will be PRs without the additional cost of new medicals not to mention the risk of say failing new medicals or some other issue arising to delay your landing.

3. The school thing - unless your kids are in a crucial year say junior high to senior high then they catch up.

4. 3. I think you will find it best to land within the validity of your PR visa then deal with other stuff accordingly but hey its your call.
