Hello everyone,

I would greatly appreciate it if you kindly give me some advice..

We were a permanent residents From the years 2007 to 2012.
But unfortunately we did not meet the residency requirement in Canada and we had to leave in 2008 due to family problems. (unfortunately We had a Very serious issue in the family)
My question is this:

1) Are We Still a PR?
2) Could I enter Canada with my new passport as a tourist (our country's passport does not need a visa to Enter Canada) and assuming a policeman immigration would give me to enter as a tourist, Can we remain in Canada for 2 years without leaving?

3) Can i trying apply to renew the PR card once we meet the residency requirement again?
4) Can I try to use my SIN in order to work in Canada? (how can I know if it’s still activated?)
3) Or maybe The best way is to try write a Latter to the immigration (Or the Local Canadian Embassy) that explains the issue?

As your PR was never officially revoked, you are still a PR.

If you are able to enter Canada without getting reported, there is a loophole that allows you to put your PR status back in good standing by staying 2 years. You can at that point apply to renew your PR card.

If you want to know if your SIN is still active, you should go to Service Canada and ask. If it isn't, you can have it re-activated.

As a PR, you are allowed to work. You may however face challenges living in Canada without a valid PR card for 2 years with things such as getting a drivers license, getting health care and possibly even getting a job because some employers ask for it as well.

If you would rather write a letter to immigration trying to get them to accept your reasons for not living in Canada since 2008, you would use this application: http://www.cic.gc.ca/english/information/applications/travel.asp for a PR travel document. It is meant for a PR who is outside Canada to apply for a document in order to return. However, be advised that applying for this document can cause your PR to be officially revoked in case immigration does not accept your reasons.
 
thank you for answering my questions.

Suppose I am in Canada and two years later I'm trying to renew the PR;

1)Is immigration officer will ask me why I entered with a tourist visa?
Can it cause problems to renew the PR?

2)if i will try to enter with my 3 years old child, can i Sponsor him under PR status?

1) If you can remain in Canada for 2 years then you shouldn't have any issues obtaining a renewed PR card.
2) You won't be able to sponsor your 3 year old child for PR status until after you have lived in Canada for 2 years and meet the residency obligation.
 
Is there a way to check outside Canada if the SIN is still active?

Does Service Canada need a valid PR to re-activated the SIN Number?
(Or i just need to show the Old SIN Card?)

It is most likely not active if you have not been in Canada and not filed taxes in Canada in the past 5 years. There is a thread here about reactivating: http://www.canadavisa.com/canada-immigration-discussion-board/returning-canadians-sin-t57370.0.html

It seems you just have to fill out a form at Service Canada and they will fax it somewhere and wait for 2-3 weeks to re-activate. You shouldn't need a valid PR card. You would have to prove who you are though but you can show your passport.

I have additional question regarding our PR status (Me and My wife).

we've planning to come Back with our two children, and they do not have the Canadian PR.
(As i said before, we did not meet the residency requirement in Canada therefore were unable To Sponsor)

1) Do i need to obtain Any apical permit for them to enter Canada?
(Our passport do not need a visa for entry to Canada, so can we Just Enter as a tourists? What will happen When i try To Enter Canada with my kids?)

2) Assume we've all crossed the border and were able to enter Canada without any problems
will schooling/kindergarten admission be possible while they will be as a Visitor status?

3)My wife's parents are Canadians, will the able register our kids in the Canadian System?
(in order to give them health insurance and sign up for schools)

PLEASE ADVISE.

1) You don't need a visa for your kids if they are visa exempt. You can attempt to enter as tourists but if immigration knows about your PR and that you don't meet the RO, they can report you.

2) Schooling depends on the school district. Children who are visitors generally don't have the right to attend school. They might however be admitted. If the grandparents take them and explain that they are their grandkids and staying with them, it's possible. Or you can send them to private schools and pay for it.

3) I do not think that citizen grandparents would be able to get your kids registered with provincial healthcare while they are on visitor status. However, you should have some type of travel insurance to take care of emergencies.
