I don't want to ask for assistance if I don't have too, but currently we are working together in our company, and living together. I am actively looking for another job, but without Family to temporally move in with I have to find some place on My own. My current salary will not support this, and he refuses to leave the house. I don't want to take My Son 20hrs from his Dad (they do have a somewhat decent relationship.)

Lots of decisions to be made and I just wanted to make sure I knew My Options.

Thank You to everyone for their replies.

Good luck - hope you find a suitable job soon so that you can change your living situation!

First and foremost, you need a lawyer.

Your husband does not get to keep your house by himself. If he doesn't want to move, he will have to buy you out and pay you your share of the house. If he can't afford that, he will have to sell the house and you split the money.

So "20 hrs. away" is by car? Still in Canada? You have family there? You should talk to a lawyer before you decide if or where to move. Moving outside Canada or to another province during a divorce may complicate things.

On a different note, if you have spent at least 1095 days in Canada in the last 4 years,(so between 2009 to 2013), you are eligible to apply for Canadian citizenship. You are likely going to need evidence of your physical presence in Canada such as proof of employment(business records in your case), tax records, etc. These will be easier to put together now that you still live in the family home. When you move, it could be challenging to obtain them especially if your husband decides to make things difficult.

Umm, you mean 1095 days in the last 4 years, don't you?
