From the timeline you included, it seems that your husband got PR in 2010. This is 2013. Technically speaking, you are supposed to be responsible for him financially for 3 years after he arrives as a PR. If he is not going to be a burden on Canadian Government for the next 4 months, I don't see why you can't divorce each other. It will have no impact on your or his PR or future Canadian Citizenship.
Obviously, the Divorce process itself s a completely different matter altogether and you should talk to a lawyer.
No, he cannot be sent back. Even IF the new "conditional" PR had been in place back then, him sticking around for 3 years would have met that condition too.
Good answer as for me I would send him back with one good kick and then wise up and get a local newspaper on it and get his photo in the papers of what he has done to you and your family!!!

It can be complicated indeed (to divorce).
If it's amicable, it's easy.
Otherwise, it's a long process.
He's a Canadian PR now, the sponsorship is very valid and about to expire, hopefully he hasn't applied for welfare, otherwise you'd be stuck with the bill.
