Hi everyone! Looking for advice here as my husband and I are considering Spousal Sponsorship.

Me & my husband has been together for 4 years and married for almost 1 year. He is a PR. He has significant ties to Canada as we have properties together, his address is here, long relationship history. The thing is that he works full time in the US, commuting to the US 15-20 days a month and returning to Canada 10-15 days a month to be with me.

We can prove our relationship is genuine. The thing I’m not sure is whether IRCC will consider my husband to be residing in Canada. He works in the US & spends 50-70% of his time there. He has plans to be fully back in Canada in the next 1 to 2 years.

Would it be possible to wait 1-2 years to file the sponsorship?

What is your status in Canada and do you need some new/continuing type of status (i.e. based on the spousal sponsorship)? Or do you have a status that is good for the expected processing time (e.g. 12 months or so)?

Because two possibilities (not the only ones):
1) Apply as sponsor-outside-Canada (returning to Canada). Sponsor will need to provide evidence on intent to return to Canada. Can include a letter of explanation that part-time residing in Canada (paying taxes in Canada? potential minefield here), but expects current job situation to change in a year or so. (Could potentially be phrased as 'being completely open here' for transparency).
2) Or just not worry about it and apply as living in Canada. My guess is that if established here with place to live etc, not a big deal. Just note US employer and stays in Canada right now due to slightly different work situation.

I don't think this is going to work to be honest. He's spending more time in the US vs Canada so the US is his primary place of residence. You can try, but thinking you will need to wait until he's moved to Canada in 1-2 years before he will be able to successfully sponsor you. Make sure you apply outland. You won't qualify for an inland application given you aren't really cohabitating.
