I've got PR card in March 2012. I had a problem with my health and wanted to travel India. I've enquired with my lawyer and he said there wouldn't be any problems. I've booked ticket and during my immigration, I was said if I travel now, I would be no longer eligible to enter Canada again. I had return back to my home.

Could you please tell me how long I should stay in Canada, so that I can travel to India, because my health has been very worst and home sick.

I've never observed this rule what the immigration officer has said. Could you please clarify on this. I would be grateful!

Thanks,

Since you are PR, you can stay as long as you want in Canada. But if you would be out of the country, make sure you have maintained your residency obligation by physically living in Canada for 730 days in a 5 years period.

Its been less than a year that I've got PR. Until I complete 5 years, wouldn't I be eligible to travel outside canada?

You don't have to wait 5 years. You can travel anytime. Just make sure you maintain your residency obligation or else you might lose your PR.

Could you please clarify one thing - Since when this 5 years is counted ?

- Is it the date on which the PR visa is issued (Before landing ) or
- Is it the date on which I enter Canada to become PR or
- Is it the date on which PR card is issued ?

Looking forward for a reply

gmyeni ,their is no restriction to stay in canada but do maintain ure pr status as others have advised you .go and see a doctor abt ure health issues .secondly plz dont get home sick so much, now a days skype is available so u can feel close to ure family . try to mingle with friends and if not ure own community . ppl live in hostels its not easy but dont go in depression . only its ure will power so try to go for recreation, watch movies etc :) . keep ure self busy otherwise its very difficult to coup with home sickness .

Thank you all for your responses.

If I could travel anytime, why would the immigration officer say that I would be suspended if I would travel to India now. I've packed everything and went to airport and was to board the flight in few mins. As soon as I entered immigration officer he said, I would be eligible to travel next year in the month of March as it would be a year that I got PR.

I was literally confused on these rules. I dint want to take a risk of questioning him, so I had to drop my travels.

It really sucks when you're prepared for everything, and all of the sudden like this happens.

i cant understand as many friends after getting PR card returned but if rules ve just changed i cant say anything but you should clarify from the officer in a nice way as now you are going to be citizen their dont be afraid .u should know abt ure rights .you are not a prisoner their you are a free person ::)

Is this rule for provisional PR by any chance?

Hi Gmyneni,
I guess it is a new rule, if you were told by the officer. so many new rules in place this days. But let them put it on the website. So like you have been advised. Try to keep yourself busy and make some friends around. Do not worry all will be fine.

Hope it helps.
