Hi,

I am a protected person in canada who applied for PR status from within Canada. My son is back home and I inluded in my application. They rejected his application. Is there any further steps I can take now? The letter did not mention anything regarding an appeal.

Here is some background information:
-He is 25 years old
-Full time student
-The rejection is based on the fact that the officer was not satisfied that my son has been continously enrolled in school full time.
 
I can't say much on the case however one point I like to ask is this. Did your son actually continued his full time courses during the summer. The requirement is that the dependent must be continuously taking his education courses full time. So did the son take summer semesters off at anytime during your PR processing. Usually the majority of students takes courses from September to April and take on summer jobs between May - August to cover tuition costs / student loans.

The son cannot take any time off from studying full time at university / college at any given time. He must be studying full time from Sept - August year round.

Athough you are applying for PR through refugee status, i am not sure if you have a right to an appeal. I know that inland applicants through PR spousal sponsorship does not have any rights to an appeal. Only applies to those who applied "outland". Since you applied inland through refugee I don't know.

You should be able to appeal. However as screech said, how successful this appeal will be will depend on the strength of the evidence you provide. Your son must have been in school without a break in order to qualify. Since he's 25, this would mean that he should be working on a PhD at this point or on becoming a doctor - or some other education path that requires this many years in school. If he was just taking simple courses (e.g. language courses) the entire time then you can expect another refusal and there is no point appealing.

But why wasn't he going to a regular College/University? Was he taking short courses?
Go for an appeal, definitely.
