Hi there, I need some help. My Spouse (Canadian) and myself (American) have our PR application submitted. I flew into Canada in January 2010, upon me stating my intentions for the visit were to prepare for our upcoming wedding (April 2010), I was immediately sent to Immigrations and grilled for a good 45 minutes. My husband and I had previously hired an immigrations lawyer to help us with our application to make sure everything would be in order for submission. I presented the immigrations officials with the correct forms (Lawyer Legal Reprsentation form, a letter of intent from my husband (fiance at the time) stating he would be my source of financial means that I understood I would not go against the law and work illegally during my 6 month stay, also another letter from his Mother supporting me entering the country and that I would be staying in their home, and a letter from the lawyer stating that I was asking to be granted a 6 month visitor status, would not work illegally during my stay, and had a residence to return to back in America if I was asked to leave Canada after my 6 month stay was up. Basically we did everything by the book and it was still tough for me to get cleared.

Anyway, we are now married as of April, we filed my PR application in July, and the lawyer sent in an application for extended visitor status for another 6 months. My Mother contacted me the other day saying she was having my son (who lives with his Father in America from a previous marriage I was in years ago) fly in to visit them and she said he didn't want to come if I wasn't there with him. So she said they would pay for my ticket to fly back to the US for a week to visit with them and my son.

My question is, if I fly out of Canada does that cancel out the visitor extension he filed and I have to start anew again? Will I be grilled at Immigrations at the airport like I was when I flew in last time and possibly not be able to reenter Canada and stay with my husband?

Yes - leaving Canada cancels the visa extension request.

Did you file an inland application or an outland application? Hopefully you were working with a good lawyer and he/she directed you to outland since you are American...
 
Our app was submitted to Buffalo, NY.

Would I be ok to enter Canada again after the week visit to the US? Would it just open up another 6 month visitor status?

Unfortunately no one here can tell you that. Since you ran into problems earlier - there's always a chance your file could have a flag and you'll be stopped again. Or maybe you won't. Again, impossible to say for sure.

Technically US citizens are permitted to visit for six months (as you know). However it's up to the agents at the border to either allow a normal visit, approve a shorter trip (less than six months) - or even deny entry completely.

If you are able to enter Canada again, then yes, that would restart the six month clock (assuming the border agents don't approve a shorter visit instead).
