PR advice

Hi There,
We are a family having a PR cards with expiry date on August 20, 2015 , our first entry to Canada was on July 7, 2010 , then we left on August 15, 2010 . We are still outside of Canada .
My questions are:

1- Can we re-enter Canada in early 2015, before PR expiry date, then settle for 3 years as required?
2- Is there any risk due staying out of Canada for more than 4 years (i.e. we would be having less than 730 days within the 5 years)? Will we be in troubles with the related authorities?

I appreciate your prompt advice/answers.

The risk is as follows:

When you re-enter Canada, you could be reported by immigration for failing to meet residency requirements. If you are reported, you will have to appear in front of a judge to argue why you should be allowed to retain your PR status even though you haven't met residency obligations. If the judge rules against you, you will lose your PR status and will have to leave Canada.

If you enter Canada without being reported, then you can remain in Canada for 730 days straight and then apply to renew your PR status.

If you want to guarantee that your PR status will be retained, you must meet residency requirements and return to Canada earlier than planned.

Are there any legal procedures to request CIC for an extended period of time over the 3 years outside Canada? and do I need to ask an experienced Immigration lawyer?

No - there are no legal procedures to request an extended period of time over the 3 years outside of Canada.

I think you would be wasting money on a lawyer - but it's obviously your choice.

Not a good idea. Obtaining citizenship currently takes around a year and a half (and much longer if there are any questions about the application). Go ahead and apply for citizenship when you meet the three year residency requirement - but apply for your PR cards as well at the two year mark so that you have valid cards while waiting for your citizenship to be processed.

So please, if you like to help that is good ,otherwise do not waste your & our times .
