PR accepted alone if there is a divorce going on and Affidavit Submitted for non accompanying.

Respected Members, Are there any cases where CIC granted PR, on the basis of affidavit stating spouse is not cooperating for PCC & Medicals, and I would not apply for sponsorship for her in Future?

The Divorce case is in courts and would take years (as advised)

A comment would be appreciated.
