I am in midfle of preparing customised checklist for EAPR. I got SINP nomination with spouse's old name. But after getting nomination spouse got reissue of passport with change in particulars such as spouse name addition on passport as well as name on passport (new name after marriage).

Now I have asked SINP for revised nomination with new changes and new name for spouse. But while filling post ita questions I have mentioned yes for question "have you ever used other name?" For spouse. Hence now it is asking for document for change of name?

My questions are
1. What document is required to submit for proof of change of name for Indians?
2. Do we need to mention yes for "have you used other name in past" for spouse's old name?

Please guide me as I need to arrange change of name document

1. The marriage certificate is the name change document.

2. Of course, as she did use another name...

Marriage certificate does not have new name. It contains her old name details only. Marriage certificate has been asked for mandatory document in principal applicant section.

The legal change of name document could not be marriage certificate. Any other suggestion for legal change of name document?

You will have to submit a notarized Affidavit for name change after marriage. The Affidavit should mention the maiden name of your spouse, date of marriage and the new name. You should also affix a joint photograph and the Affidavit will have to signed by both of you. There are numerous formats available online, you can check for one that would be applicable for your country. Additionally, you will have to submit copy of marriage certificate and copy of your and/or spouse's passport (if spouse's name has been added to the respective passports).

In Canada, a person can change their name to their spouse's using just the marriage certificate. There is no need to get a formal name change or document to do this. If there is ever any question of the new name, the marriage certificate is sufficient proof.

Thanks Canuck! My spouse has given ielts a with before marriage name and I had submitted all federal forms to PNP with that name only. Now as she got reissued passport with new name hence I clicked on name changed question in EAPR questions... Which is why it is asking for this legal name change document. Marriage certificate is going to be there as proof for our marriage.

Should I just attach marriage certificate with letter of explanation?

@stanlee if we have marriage certificate then why we would need joint affidavit with photograph? I have a gazette notification published by state government, so I m also thinking of attaching it.. What your opinion on this?

Yes, that will be fine.

Here is what CIC says about name changes, albeit for a passport app:

Change of last name due to relationship change

If you are changing your last name due to a change in relationship status, please provide a copy of one of the following documents with your application (copies do not need to be signed by your guarantor):

a marriage certificate; or
a common-law relationship certificate; or
a court order (i.e. separation agreement or divorce order/judgment) issued by a court of law in or outside Canada; or
a certificate to dissolve a registered common-law relationship; or
a resumption of surname certificate.

You need to submit affidavit, indicating old name and name after marriage with passport number, for evidence attach a marriage certificate.
