My husband has just sent his PP back to POS by DHL and we are now waiting to get it back. I'm trying to plan his flight back to Canada and prepare him for what may happen with CBSA once he lands.

Hey Trini, thanks for the quick response. I've sent several CSEs (starting in July) but have only received one automated response ever and that was Monday. IDK if the other CSEs went through but when I sent them, I got the 28 days msg....So idk. Well let's hope these suckers respond. Im tired of waiting.

Well Forum, Friday is around the corner. Hopefully we can get the ball rolling before the weekend commences POS. Let's goooooo with the PPRs and updates.

The many times I have entered the states, I had a visa. Initially, when I was younger, I used to travel on my mom's passport thats's when we travelled together but she later transferred that visa into my own passport and that's when i started traveling alone.


I know you mentioned of backtrack but unfortunately I know of no one in your situation.

Thank you soo much for the quick reply!!...i'm very frustrated thinking what to do. I recently spoke to someone who is in my situation and went to Guyana for the interview and he advise me not to go if im called for an interview. He is there 6 months waiting. He got a letter saying he committed a criminal cat by coming to the States illegally.

Do any one knows anything about this situation?

This immigration process requires sacrifice and life is all about taking risks. Everyone seems to have an opinion but you should consult with a lawyer. Everyone's situation is different. You were also a minor too.
If you miss your interview, you will be refused. I don't think the IO questions your status in the US or how you came. That comes in when determining where your application has to be processed. At the interview, you are proving that your relationship is genuine. That's it! Make sure you have additional documentation addressing that.

:D :D :D :D On a positive note, you may not be called for an interview.

Just out of curiousity---->Did you use your Guyanese address or your U.S. address when you filed your application?

Take a look at this thread. Maybe you can get some help. Just a brief: SaraLune's husband tried to enter the US illegally and was caught. It showed up on his FBI record but he still got through. It is different from your situation but a bit similar.

However, the fact that you entered on someone's passport and visa, you may have to do an fbi clearance on their name as well as yours and submit an explanation when submitting your paperwork to CIC....IDK. I'm only assuming here.

Maybe you can ask this question on a new thread: Are you inadmissable to Canada for using someone's passport and visa to enter the U.S.? Explain your situation. Try to address this question to top members like PMM, Leon, Scylla, Rejessome, and Qorax.

my daughter has interview with pos on Tuesday, they have previously requested her/baby passports, I beleive she will get her visa on Tuesday. Best of Luck all

It depends on how you entered into the US, legally with a Visa using your own identity and overstayed or illegally using someone's identity (backtrack). CIC is very particular about how you entered into the US especially if you have no legal status.

If you have entered using fake documents and different identities, then you have automatically breached an immigration law and is considered inadmissible to Canada.

If you have used your own documents and entered on a legally issued US Visa but overstayed, you have a better chance of scoring.

A friend of mine is going through the process of ADR because her husband was rejected under "inadmissibility" as he entered the US illegally using fake documents. The IO admitted that there is no issues with their relationships but he is seen as a "criminal" because of his silly mistake some 10+ years ago.

It's a very serious offense. I would suggest if you are in this situation that you seek a proper immigration lawyer to go through your options. I wouldn't listen to people's advise and not show up for your interview in Guyana or Trinidad. It is important you attend your interview. Not attending your interview will burn your bridges when it comes to future immigration to Canada. Maybe an immigration LAWYER, not CONSULTANT, can help you prepare to answer questions at your interview regarding how you entered the US.

One other thing to keep in mind is get all legal documents you have from the US whether police or Government to show you have no criminal records.

If you are rejected from Canada because you are viewed inadmissible, I think you still stand a chance of having that inadmissibility overthrown once you can prove your living situation in the US (local police checks from all regions you've lived since you landed) and genuineness of relationship but it could take you through the whole 10 yards of ADR and follow-up hearings with your spouse in Canada. It's timely and you can look at spend about 2-3 years (the max) in Guyana to wait out the process.

@ks232 Confused is right. Travelling or using someone else's id, passport or visa is a fraudulent act. I don't even think you are even able to adjust your status in the U.S. for entering this way. Do seek legal advice. I have faith in your case though because you were a minor when this was done.

I'm sitting here preparing a letter to fax to the POS VO.
When should I order my CAIPS? I'm slowly approaching 9 mths in Dec....no aor.....no e-cas updates....nothing!
