- My mom came to Canada on Mar 2022.
Applied visitor record on Jul 2022. - Old passport expired on May 21,2023 and New passport is issued on Jan 2023 but we did not notify IRCC for the update.
- Visitor visa expired on May 20, 2023.
- Visitor record decision of refusal is made on May 19, 2023. The letter tells to leave Canada forthwith.
I guess the primary reason is expired passport. My mom has to stay with me on another 6 months and she is unable to leave now. Can anyone give me advice? Should I apply restoration of status for her? Any other options? Much appreciated!
below is the refusal letter:
This letter is in reference to your application for temporary residence. Based on your application
and accompanying documentation that you have provided, I have carefully considered all
information and I am not satisfied that you meet the requirements of the Immigration and
Refugee Protection Act and Regulations. Your application as requested is therefore refused.
Persons wishing to extend temporary resident status in Canada must satisfy an officer that they
will leave Canada by the end of the period authorized for their stay, that they will not contravene
the conditions of entry and that they do not belong in a category of persons inadmissible to
Canada under the Immigration and Refugee Protection Act.
In reaching a decision, an officer considers several factors, which include the applicant’s:
1. Reason for original entry and reason for requested extension;
2. Ties to country of permanent residence, including:
- employment and study commitments;
- family ties and responsibilities;
- status (citizenship or immigration status);
3. Financial means for the extended stay and return home;
4. Travel and identity documents;
5. Probability to leave Canada at the end of authorized stay.
After considering all the circumstances of your case, I am not satisfied that you meet the
requirements of the Act and Regulations.
Pursuant to section 183(5)(a) of the Immigration and Refugee Protection Regulations, your
temporary resident status has expired. You are now a person without status in Canada and as
such, you are required to leave Canada forthwith. Failure to do so could result in enforcement
action being taken against you.
Should you voluntarily depart Canada, no further action will be taken against you. However,
failure to confirm your departure may result in enforcement action being taken.

Should you decline to depart Canada voluntarily, a Section A44(1) report may be referred
to a minister’s delegate where it is possible that a removal order may be made against
you.
