Hi

We are in the process of applying for our PR. My husband who is the main applicant is a international student at University of Toronto and we have been in Toronto for only past 4 months and are confused in which one of the scenario do we fall between point 2 and 3 mentioned below so that we could be clear about whether to submit our application to Buffalo or Nova Scotia.

As per the website cic.gc.ca under the following URL page http://cic.gc.ca/english/immigrate/skilled/apply-how.asp#step3 , it mentions as stated under for submitting application:

Send your application and processing fee to the appropriate office. One of these three scenarios should apply to you:

1. If you have arranged employment, you will apply to the visa office responsible for your country of nationality or residence.
2. If you are a foreign national who has been living legally in Canada for one year as a temporary foreign worker or an international student, you will apply to the visa office in Buffalo, New York (United States) or at the visa office responsible for your country of nationality. See the list of Canadian Visa Offices to find out where to submit your application.
3. All other federal skilled worker applicants will apply to Sydney, Nova Scotia (Canada). You will receive a letter advising you whether or not your application will be further assessed by a visa office.

On page 4, you can find the categories:

If you meet the criteria in one of the categories below, your application will be placed into processing if…

1. you are in an occupation which corresponds to the list of occupations identified in the Ministerial Instructions and have evidence of one year of continuous full-time (or full-time equivalent) experience in that occupation

2. you have an Arranged employment offer with a Canadian employer

3. you are a student or worker who is legally residing in Canada, and have done so for at least 12 months immediately before submitting your application

On page 20, you can find the information on what to send and where for each category.

You can find the list of occupations for category 1 at http://www.cic.gc.ca/english/immigrate/skilled/apply-who-instructions.asp If none of those apply, then either you have an employer who promises to employ you when you get PR (category 2) or you will have to wait until you are in Canada for 1 year (category 3).
