Hi Everyone,

Have some questions and hoping from some guidance from the experts.

My visa and work permit are about to expire on April 14, 2014. My intention was to apply for the residency on October and in January after I got the AOR apply for the Open Work Permit, but due to family a situaion (death of my father) I have not had the time till now to actually look at all the process and start applying until now.

However, now I am 3 month away of my expirations dates and therefore I don't know if I still have the time to send the CEC application, which I still need to finish putting documents together (letter of references which takes a while to get). Which means that probably will send the application in 15 days or even a month and that will probably, if lucky, get me an AOR right around April 15th when my visas and work permit expires. If that is is the case I would not have time to apply for the OWP since one of the requirements is to be within 4 months of the expiration dates.
(1) Am I right in my assumptions???
(2) and if so will I be out of status
Or (3) can I send the CEC application and along with it send the OWP application?
Or (4) send the CEC application and send the regular extension for the work permit BUT probably after my visa and work permit has expire since I would have been waiting for a chance to get the AOR before April 15th so that I coould apply for the OWP (is this possible)?

Otherwise, I need confirmation from you guys if I will be loosing valuable time because of my timing and therefore just apply since now for the extension of my regular Work Permit and my visa and later apply for the CEC application so that I don't fall out of status? PLEEEEEEAASSSSEEEE your help is greatly greatly appreciated - I assure you I am working really hard on getting things done as fast as possible.

Get your PR application done and send it as fast as you can and as soon as your ecas status says application received.
Then send your BOWP application. You still have enough time if you move fast.

Thank you very much for your responses.

In reality I must probably will send the CEC application on Feb 15th (besides reference letter also waiting on FBI criminal clearance since I lived in the USA). IF I send the CEC appl. on FEBRUARY 15th will I still have time to get the AOR and then apply for OWP??

And if not what do you suggest I should do?

You can send your police clearance certs later - they do not need to be part of the original package.
Once that's in, keep an eye on the timelines here for AOR and you may be able to predict when you'll receive yours. If you get your AOR and apply on April 13, ie day before your work permit expiry, you go on to implied status while a decision is made on your owp.
 
If you send application on Feb 15th, you should get AOR by first week of April. Maybe even before that. But you should not delay anymore.

Just make sure your BOWP application is prepared and ready to go out, so once you get AOR, you can apply for BOWP asap. BOWP does not take long to get approved. Recently I have seen people get BOWP as quickly as 6 days (avg 2 weeks give and take).
 
Police clearance is not required at time of application, but you should start getting it because cic will request it.

get your permanent residence application sent out as soon as possible, you probably will get it about 1 month and half or even sooner. Once aor received apply your open work permit online, current processing time is 10 days. worst case even you don,t get aor before work permit expiry, you can send out your work permit anyway, as long as your aor will be issued when they process your work permit you will be fine, base on cic operational manual visa officer will check gams notes before making decision as long as they see your review is positive you an still get work permit.

Last, as long as you send out work permit expiry you will be implied status, so you are still on valid status and you can keep working.
