Are you common-law partners (must live together continuously for a year)? If not, you must be married to sponsor him.

You can sponsor him inland (long processing times) or outland - depends which one is faster. Where's he from?

Scylla already answered your question here:

He is from Tunise , and he is illegal in US. He was legal for one year when he came to US. I read some posts it says if you were legal in US for one year then you can apply through Buffalo. Its faster process pls need advice

There is no Buffalo office anymore. It closed several years ago. US outland applicants are now handled in Ottawa.

But you have no control over which visa office will handle the application. ALL applications first go to Mississauga (as Scylla mentioned in her post in your other thread) for sponsor approval. If that is successful, then CIC will decide where to send your application depending on a number of factors. They will let you know where they decide to send it to. You have no control over this. Up until recently, you could "request" which office you'd like the application to be transferred to (though CIC still decided on their own where to transfer it to), but now they updated the forms so that you don't have the option anymore.

Thanks for make it very clear to me... So in this way may be they will call him NY for interview not in his home country. Atleast there is a chance

if you mention his US address then he will be required to provide FBI check (including illegal times). CIC doesn't care about it but if FBI gets to know about it, there may be issues.

If CIC transfers his application to Ottawa (where US residents go) and they need an interview with him, they will transfer it to LA and he will have an interview there. If they transfer it to the office that handles applicants from Tunisa, I think it that is Paris and probably that is where the interview will be (if an interview is needed)

I think they will transfer his application to Paris but that is just my guess.
