Hello everyone

basically i have been in canada since 2010 as a student i entered college in 2012 and i got a certificate in general business, i couldn't get a diploma because my parents have no more money to pay my studies so i can not continue. My visa expires january 5, 2014 and i won't be able to renew it because of my parents lack of capital.

I been dating my canadian love for a year and started living together in august, so were doing the common law relationship. I was planning to overstay here and become illegal in order to continue the common law relationship but yesterday i just checked that people get letters saying that they have to leave canada and stuff so i got scared that the government come to our basement and kick me out of the country( school and bank have my address)

So we decided that i am gonna leave the country around december so i don't get in trouble with immigration and planning to apply under the conjugal relationship option from my country so she can bring me back later, Can we do that? Also are there any income requirements for her? honesty she makes too little( she works at tim hortons full time and makes 10.25 an hour) This really worries me because i heard that you need a certain amount of income in order to sponsor your partner.

If anyone knows this please let me know! i am really desperate :( i love her so much and we don't want to be separated. I am 21 and she is 19 Canadian born. I am from Mexico
 
Income does not matter for 'spousal' sponsorship.

You will not be able to leave and then apply for a 'conjugal' relationship as that is reserved for folks who can not legally be together.

You have the option to change your current status from 'student' to visitor before you current visa expires. If you change your status to visitor, and then apply for an extension you may find that you can in fact legally stay until you and your girl meet the 12 months required for common law sponsorship.

Again though, the amount of money she makes is irrelevant for this type of sponsorship, so long as she does not receive public assistance then she will qualify in that respect.

Thank you so much for your answer but i have a few more questions

If we are in different countries and we can not live together because of immigration( visas,no more money) wouldn't that be considered conjugal relationship?

What would happen if try to change my status and it gets denied?

How am i supposed to proof financial support when i have no more money?(they ask for it)

Conjugal is pretty well reserved for same sex relationships and those who can not legally marry because divorce is illegal where they live. There are very certain rules for conjugal and your situation doesn't apply.

Applying for a change of status and being denied would net you the same result you began with. Leaving the country to stay in legal status.

You can't do conjugal because of "no more money". Conjugal is for couples who are not married, and cannot live together for reasons beyond their control. If she had not enough money, she should've worked a better paying job, or worked 2 jobs.

Visitors must show proof of funds to support their stay. Without money, you have no chance of approval.
