Hello guys,

I’m in a deeply depression for few weeks. If someone could help me, We are going to try to fix that situation.

My wife got the student/work permit and I got the open work permit.

My wife took a break on her first year in college, “authorized break” on the summer. We didn’t know that she can’t work and me either. So, both of us worked full time during this break.

She asked for that break and the international advisor authorized the break, why he did that? if he knows that she can’t work? Because he asked for the reason and she said, I need to work to get some money for the next semester.

What can we do? How can we fix that? This year we discovered that she isn’t eligible anymore for the PGWP. But we do itend fo apply for the PR through express entry.

How can that impact to us? I’m in a deeply depression, very frustated, I cannot sleep or eat properly. And I’d like to know what can we do to fix that situation.

Is it possible to send a letter? Talk to CIC over the phone?

After that break she came back to her college and she didn’t receive notifications from her college. She is studying full time since Fall of 2017 and she’ll finish at the end of 2018.

We worked during that time last year and we paid taxes also! Because we didn’t know that we cannot work!!

What can we do?? We’re in a big problem?? Please, help me, I cannot live anymore with that problem!!

I appreciate your help, I need peace, I didn’t make it intetionally, We’re correct people that made a huge mistake and want to repair our error.

Sp the summer semester last year was a regularly scheduled semester in her program? Everyone else in her program was studying during that semester?

Your OWP is valid regardless of whether your spouse is studying or not, so you were allowed to work.

It is not the responsibility of the international advisor to ensure that she is in compliance with immigration law. 100% your wife's responsibility.

In that case what do you advice for us? Because we intend to apply for the PR. We also tought to extend her study permit and then she could study one year more. After that we can apply for PGWP. But after that our PR could be inadmissible.

The question is, we don’t want to affect our reputation here. We’re thinking to talk to a lawyer, if it’s possible to write a letter and say that for the government. Can we ask for a pardon? Doesn’t matter if we pay taxes? That’s really sad for us, we’re really upset and felt guilty.

I hope someone knows similar case.
 
I don't think this will impact PR. However the unscheduled break may mean she won't qualify for a PGWP.

There is no process for obtaining a "pardon". What's done is done - and you'll just have to hope for the best.

A lawyer can't do anything, the fact that she paid taxes is irrelevant and as said above, there is no "pardon". She worked illegally and there is nothing she can do about that at this point.

Given the illegal work and the break, a PGWP refusal should be expected. A study permit extension is also likely to be refused, as she failed to meet the conditions of her current study permit.

Provided the illegal work is fully declared, there should be no effect on the PR app.

Today our problem was solved, the international advisor informed us that break was a scheduled break. So we don't need to worry about that!
