Please bear with this long post. I am in a big mess. I received a refusal letter on my restoration status as a Visitor and it was written there "You are hereby a person without a legal status. You should leave Canada immediately or enforcement action must be taken against you." I am sharing my timeline in Canada to help you understand what led to this decision.
1. Aug 2015: I came to Canada on a Student Visa.
2. May 2016: I was on Academic Suspension for poor academic performance.
3. Sept 2016: Returned to college, failed few subjects.
4. Jan- Aug 2017: I was on 2nd Academic Suspension. College refused to let me study for 2 semesters.
5. Sept 2017: My study permit expired.
6. Dec 2017: Applied for study permit restoration. Stopped working & studying legally.
7. Feb 2018: Received my 2nd study permit for 2 years (expiry on 31st March 2020).
8. When I received my approval on Feb 2018, my college changed my program of study. They changed my original 1 year Post Graduation Diploma to 2 years General Program (Arts) which was not my domain of study. I requested college to give me one more chance but they did not consider it. I told them that I am a Commerce Student, I won't be able to study Arts subjects. They did not listen.
9. I went to a immigration consultant. That consultant gave me the option of working at Subway for LMIA.
10. I started working with that employer and he gave me two options: either to work for 1 year with him and get LMIA for free or pay him $35000 and get LMIA from him at that very moment. I did not have that much money so I chose option 1 of working with him for a year to get a free LMIA. I worked for a year on cash with him but paid me only $400-$500 a month cash. I never said anything to him because I wanted my papers.
11. After 1 year, I went to the same immigration consultant to start my process for LMIA but he always made excuses. He was like "we did a mistake on your pay rate", "we spelled your name wrong on application" and all. I paid him money for his time but I was fooled all along.
12. On March 2020, my 2nd study permit expired. I was so devastated because I did not have anything in my hand now. I told the consultant to file for my LMIA. He told me that we still did not receive any LMIA to apply for your closed work permit. He then applied for my closed work permit which was refused on 20 May 2020 on the basis of that "there was no LMO attached." They wrote in the letter that I have 90 days to restore my status.
13. The immigration consultant told me about this refusal decision on June.
14. I applied for Visitor Visa and received refusal for my visitor application few days ago. I am told to leave Canada immediately.
These are my 6 years in Canada. All I want is some honest advice on what should I do? Should I just leave? Is there anything I can do to save myself?
