Hi,

Please bear with this long post. I am in a big mess. I received a refusal letter on my restoration status as a Visitor and it was written there "You are hereby a person without a legal status. You should leave Canada immediately or enforcement action must be taken against you." I am sharing my timeline in Canada to help you understand what led to this decision.

1. Aug 2015: I came to Canada on a Student Visa.
2. May 2016: I was on Academic Suspension for poor academic performance.
3. Sept 2016: Returned to college, failed few subjects.
4. Jan- Aug 2017: I was on 2nd Academic Suspension. College refused to let me study for 2 semesters.
5. Sept 2017: My study permit expired.
6. Dec 2017: Applied for study permit restoration. Stopped working & studying legally.
7. Feb 2018: Received my 2nd study permit for 2 years (expiry on 31st March 2020).
8. When I received my approval on Feb 2018, my college changed my program of study. They changed my original 1 year Post Graduation Diploma to 2 years General Program (Arts) which was not my domain of study. I requested college to give me one more chance but they did not consider it. I told them that I am a Commerce Student, I won't be able to study Arts subjects. They did not listen.
9. I went to a immigration consultant. That consultant gave me the option of working at Subway for LMIA.
10. I started working with that employer and he gave me two options: either to work for 1 year with him and get LMIA for free or pay him $35000 and get LMIA from him at that very moment. I did not have that much money so I chose option 1 of working with him for a year to get a free LMIA. I worked for a year on cash with him but paid me only $400-$500 a month cash. I never said anything to him because I wanted my papers.
11. After 1 year, I went to the same immigration consultant to start my process for LMIA but he always made excuses. He was like "we did a mistake on your pay rate", "we spelled your name wrong on application" and all. I paid him money for his time but I was fooled all along.
12. On March 2020, my 2nd study permit expired. I was so devastated because I did not have anything in my hand now. I told the consultant to file for my LMIA. He told me that we still did not receive any LMIA to apply for your closed work permit. He then applied for my closed work permit which was refused on 20 May 2020 on the basis of that "there was no LMO attached." They wrote in the letter that I have 90 days to restore my status.
13. The immigration consultant told me about this refusal decision on June.
14. I applied for Visitor Visa and received refusal for my visitor application few days ago. I am told to leave Canada immediately.

These are my 6 years in Canada. All I want is some honest advice on what should I do? Should I just leave? Is there anything I can do to save myself?

Please advise all & senior members.

8. I will be honest. I was working on cash while waiting for my decision. I am not justifying anything but it was a toxic workplace where I was paid peanuts for so much work.

10. I was so naïve & stupid. I took the worst decision of my life. I went to a immigration consultant. That consultant gave me the option of working at Subway for LMIA.

I did not have that much money so I chose option 1 of working with him for a year to get a free LMIA. I worked for a year on cash with him (another grave mistake). He was very toxic and ill mannered, he used to curse a lot and made me work so much but paid me only $400-$500 a month cash. I never said anything to him because I wanted my papers.

14. The immigration consultant told me about this refusal decision on June. I was in severe depression. I wanted to kill myself. I was lost. My mother told me to leave this province and go live with my relatives who were in Ontario. I came here in August.
15. I lived with my relatives and they advised me to apply for refugee. I was not in favor of this. I went to few immigration lawyers and they advised me to restore my status as a visitor.
16. I received refusal for my visitor application few days ago. I am told to leave Canada immediately.

These are my 6 years in Canada which were full of disappointment and failure. I don't see any hope in the future, I am completely destroyed and shattered. I don't know how I will face my parents. This is my worst nightmare. All I want is some honest advice on what should I do? Should I just leave? Is there anything I can do to save myself?

Well, you’ve pretty much made every effort on your own to make yourself ineligible to remain in Canada. Seems IRCC sees no reason for you to remain, as you have failed to live up to the commitments required of you and have gone as far as to flagrantly break the law......you should take the hint and go home.

Given your impressive history of knowingly violating Canada's immigration laws, there are really no substantial options available to you. I'm sorry your decisions have led you to this point, but there isn't really anything I am aware of that you could use as a further, last-ditch effort to continue to evade Canada's immigration laws.

You’re asking for “ honest “ advice when you yourself have worked for cash , as you have mentioned, and flagrantly broken the laws of the country you wanted to live in ?
You need a reality check , then asking for honest advice online

That ship has sailed
Time to go home

When you had to explain years of your life prior to the situation that brought you here is the real message that you have now. There is no advices for you here, is one reason why Immigration consultants are not trying to help you. This forum is one place where everyone comes to seek advice before they go meet a lawyer, and you reached here after visiting a lawyer.
Dude do what IRCC is asking you to do now. You know very well you ducked up even though they gave chances.

@Singh_Manminder
Everyone made mistakes ! and yours are basic compared to others.
NEVER LOSE HOPE !
Trust me you will find a solution ! you should work with good lawyers and not consultants and be careful in this world we can meet and talk with dangerous mentally ill people. they are so mean and full of hate negative and pessimistic.
You can apply for restoration again or TRP if you have good humanitarian reasons.
Asylum i don't have an idea but i know that it take time and you should have a very specific proofs.
You can apply for PR by H&C application but also you must have a good and a strong arguments with letters and proofs etc...
CBSA will not come directly to deport you, deportation is a long process especially now with COVID, and you should know that youre case is not their priority !
they have many other priorities, and after that they will probably summon you for a meeting about your problem and your deportation, they will give you a date to leave Canada but of course you have many other options before that ! you can apply for deferral of removal for some situations for exemple if you have an h&C applicaiton or a TSR for some cases/nationalities or PRRA and its a right for almost everyone, you can also appeal for any decision and you will save time, you have to work with a very good law firm to have many good applicaitons for regularization and to know your rights.
DON'T LOSS HOPE !!! AND BE POSITIVE ! you will get it

This is such a foolhardy statement. The OP came as a student, stopped attending school, worked illegally, and you're here chirping on about how they "will get it." You are encouraging blatant immigration fraud and abuse of the system.
