3-March-2016 FINALLY!
I would like to ask a question if any one could help me about it or predict what could happen,

My husband is a Permenant Resident and he has started my sponsorship process few days ago, the problem is that he married me before landing by proxy while he was in Canada, our marriage certificate was in 17 july 2010, and he landed in October 2010 but we got married and he visited me in Egypt and made our wedding in 12 Feb 2011 after his landing, we thought that if the wedding and real marriage was after landing their would be no problem about it, but one of his friends said this might cause a huge problem, i don't know what could happen, i'm affraid they would cancel his PR and decline my sponsorship forever,

we have sent a letter to missisauga by fax to explain the situation, but we don't know what could happen!
Can anyone help us please? :-[

ohhh.. Im so sorry about your situation.. as far as i know, that is misrepresentation because you lied on the forms and your husband also lied when he landed in canada and said that he is single.. the immigration would likely know about that (they usually do).. :(

"A permanent resident or a foreign national is inadmissible for misrepresentation for directly or indirectly misrepresenting or withholding material facts related to a relevant matter that induces or could induce an error in the administration of this Act"

dorisiana is right. You should have been added to his PR application. At the time he received his passport request and the time of landing he would have been asked if his family composition had changed. Obviously he said NO although it had. He is now unable to sponsor you and he may have put his own PR in jeopardy.

Your best hope is to try to find some loophole that invalidates the proxy marriage... I know sometimes they have questioned the validity of these arrangements, maybe you can reverse engineer a case from that to have that ceremony thrown out? If Canada doesn't recognize that proxy marriage, your case becomes more straight forward.. just a thought...

(although if you happened to cohabitate for a year before he landed this will again land you in a sticky situation since Canada would have considered you common-law spouses and you should have been on his original application)

Good luck

I believe a proxy marriage is considered valid/legal by the CIC if it's regarded as valid/legal in the country in which it was performed (in this case, Egypt).

Matthewc provided some good information on this subject in the following thread:

The real marriage and wedding coming after he landed is no problem! The problem is the proxy wedding - it happened before he landed, so he should have declared that he had gotten married before he landed, and certainly when he landed. Did you mention the proxy wedding on the spousal sponsorship application forms? Did you use July 17, 2010, as your wedding date? If you did, he won't be able to sponsor you.
If you didn't mention the proxy wedding, and used Feb 12, 2011, as your wedding date, then if CIC and the visa officer don't find out about the earlier marriage, then maybe you will be accepted.

The OP mentioned that the date on the marriage certificate is July 17, 2010 which is the legal date of the marriage. That's what CIC will look at.

I'd get the advise of an Immigration Lawyer on this one on what your options are now. Good Luck

I suggest in that case that she look at Federal Skilled Worker immigration.
