Please help with common law sponsorship, and a criminal charge.

Hi everyone, nice to meet you.
I'm a canadian citizen who has been with his girlfriend for 6 years, she is not from here. We have lived together for a few years and eventually want to get married and have a family. When I was younger I was into graffiti (5 years ago) while i was alot stupider and a teenager. I got arrested for it, and so did she even though she was not involved in doing it, but the police thought she was. We were both charged, her charges where dropped, but mine where convicted, It was only a minor charge and i recieved a conditional discharge, which i completed and have not been in trouble since. We will disclose all this on our application truthfully obviously. I'm just wondering if anyone knows if this will hinder our chances at her getting permanent residency even though it was my stupid mistake and she did nothing, and was not convicted. Thanks.

This shouldn't effect you in the least. You still need to declare it on your application. Generally, CIC is most concerned with crimes against family members, such as domestic violence.

She'll also need to disclose she was charged. She will need to write a statement about it. I don't think this will have any serious effect on her application. (But I could be wrong and if I am, someone will tell me...well, us.) If she's had a clean record since then, she can chalk it up to 'teenage stupidity.' We all suffer from that for a few years

I am sponsoring my spouse and he got caught shoplifting in 2009, ended up getting community service for it and it was wiped from his record.
That being said he was still asked to provide a rcmp clearance along with court documents explaining what happened and court documents proving he completed the service.
So we are just getting ready to send in the documents to prove he finished his service.

Ive been told many times that this wont cause him to get denied, because it was summary and minor, and like you it was the only mistake he ever made in his life.

So it should be fine, i wouldnt worry to much, just make sure you have court documents or paperwork regarding what happened,and that her charged were dropped in case they do ask for it.
