Hello, everyone

This is my second time to post and I found this site trustworthy, so please the experts give me some advise on my situation. It is complicated and I try my best to stay short, starting with an easy one.

Q1- PR Obligation,
Sep 3,2008---Landing
Aug 3,2009---left Canada for 3 weeks
Aug 29,2009---came back to Canada
Jan22,2010---left Canada till now...time to stay in Canada approx. 1 year and 4 months
Expiry date on my PR card is Oct 2013, do I have problems if I intend to go back to Canada on Jan1, 2013 to complete another 8 months? I read some articles, says even if I still have 8 months remaining before expiration, the border officer can still refuse me because it is too close to the expiry date?

Q2-Driver license renewal, I got my G license expired on Apr 11, 2010, can I renew it while I am outside of Canada?

Q3-Sponsorship, my question is, as a PR,can I file my husband's PR application while I was out of Canada?and according to my husband's overstay record,will it pose difficulty to enter Canada in the future?
2004---we met each other
2004---his student visa expired he overstayed.
2004 onward,we were together
2008--I became a landed immigrant
2009--married and filed his PR application
2009--he went back to China.After 4 months,I left Canada.
2010---we live in China

They can not deny you entry to Canada when you come back but if they believe that you do not meet the residency requirements, they can start proceedings to revoke your PR. They will then let you into Canada and you will have 30 days to appeal.

When you apply to renew your PR card, you need to wait and make sure you have your 730 days in Canada (less than 1095 days outside Canada) before you apply. If you apply to renew while you don't meet the residency requirements, you are inviting them to revoke your PR.

You need to be in Canada to sponsor your husband for PR. Only citizens can sponsor from outside Canada.

My understanding is,I never know what's going to be happened even if I return on time and be able to stay up to 730 days before PR expired, right? If everything's fine,I can file my husband's PR application in the mean time,otherwise,I have to wait till I can renew my PR card,but how long is going to take to apply renew PR?can I legally stay in Canada during the application process?Thank you!
 
If you get into Canada while not meeting the residency requirements, you can legally stay in Canada and even sponsor your husband. There is no requirement that you must at all times have a valid PR card to live in Canada. They will make the decision about your PR status only when you are entering Canada, when you are applying to renew your PR card from inside Canada or when you apply for a PR travel document from outside Canada.
