Please advise on work permit extension refusal

Hello,

My Brother applied for work permit extension in January this year and just this month he travelled to India for marriage. Once he landed in India, he found out his work permit extension application is rejected. He has full time government job in Canada and currently on paid leave until 1st week of August. He also has approved SINP ( Saskatchewan Nominee program), which is valid till July 14th and already applied for Permanent Resident application on January 29th this year.

Can anyone please advise if there is possibility to restore status after rejection or if any other option can be consider to get work permit based on SINP ?

You need to tell us why the work permit was refused. He can't restore status from outside of Canada. He has to apply for a new work permit.

Yes, he does have valid TRV which has expiry date of April 2029. It shows multiple entry.

He had closed work permit as he was working for government and he applied for open work permit, which looks likely reason for refusal.

The question is, in case if comes back to Canada, can he apply for restoration again after leaving country and coming back ?

You need to tell us why the work permit was refused. He can't restore status from outside of Canada. He has to apply for a new work permit.

He had closed work permit as he worked for government, he is currently on paid leave until August. and in extension he applied for open work permit, is the likely reason for refusal. He has valid TRV till 2029 though, which is multiple entry, Can he come back to Canada based on that ?

Another question is, since he has already left Canada, and if he comes back, can he apply for restoration of work permit after leaving country ??

if he applied for work permit from India, then processing time shows almost 10 months ( 41 weeks approx.), which is long duration. he will loose SINP and employment both during this time.

He can return to Canada in the TRV but he can't apply to restore his work permit. He needs to apply for a new work permit.

Can he apply for a new work permit inside Canada upon his return to Canada based on TRV ? ..and what can happen to his present employment based on which he received his SINP and currently on leave ? ..Can he continue work after his return to Canada and if he applies work permit ?

Yes, you can apply for a work permit from within Canada assuming you qualify for a new work permit.

I can't comment on the SINP application or his employment. You need to ask that question in the PNP section of the forum.
