Hi,
I applied for a student permit extension in Jan 2026 as single mistakenly as I was unaware that common law is automatically considered after 12 months of cohabitation. I live with my girlfriend (Canadian born) since June 2024 and hence I am common law since June 2025. The student permit extension was approved in Feb 2026. After that, when I found out, we applied for tax returns as common law. Now, I am applying for PGWP. I am declaring her as common law since June 2025. I have 2 questions a) Should I add IMM 5409? B) I spoke to my lawyer and she said there is no need for explanation letter for PGWP as this is not material information. What are your thoughts regarding this.
P.S. I have no PR applications and I will not apply for sponsorship.
