I am writing to request your assistance regarding my current situation. I recently graduated from the University in January 2023 and promptly submitted an application for a Post-Graduation Work Permit (PGWP) on January 26th, 2023.

Unfortunately, my study permit expired on November 30th, 2022 and I have already applied for its renewal along with my PGWP application, prior to the 90-day deadline.

I have recently been offered a full-time job, but I am concerned that the renewal process of my study permit may take longer than expected, potentially preventing me from accepting this job opportunity. This position is of utmost importance to me and I am eager to begin my career in Canada.

I would greatly appreciate any consultation and guidance anyone can provide regarding how to navigate this situation and ensure I am able to work in a timely manner.

So did you let your study permit expire on November 30 without applying for renewal?

My study permit expired on November, 30th and since I was graduating within a month. I figured to renew study permit and attached it along with my PGWP application. As stated on IRCC site "If you don't change your status to visitor and your study permit expires, you have up to 90 days after your study permit expires to apply for a PGWP and restore your status as a student."

You are confusing having a valid study permit, and applying for PGWP and expiry of permit.

You cannot study without a study permit. You had to extend your study permit prior to November 30. Because you didn’t you were supposed to stop your studies. So you finished your program without a study permit.

What to do if your permit has expired
If you want to continue studying in Canada, but your study permit has expired, you’ll need to

  • apply for a new study permit and
  • restore your status as a temporary resident in Canada.
If you apply after your permit expires, you can stay in Canada but may not continue to study until your status has been restored and you have received your new study permit.

So you cannot work at all until your PGWP is approved. It may be refused given you studied without a study permit. The 90 days is that a study permit expires automatically 90 days after graduation. You didn’t even have a valid study permit at the time of graduation.

Thank you for breaking it down.

Considering the situation, should I follow-up through a web-form to identify with the officer my mistakes ? I I finished up all my courses in the beginning of December and was waiting on my graduation letter to apply for PGWP.

You can try. The issue is that you studied illegally, and you were supposed to stop studying on November 30 since you didn’t extend your permit. From November 30 onwards, you were out of status in Canada. You cannot work at all until approval. So if you have been working stop.
