Hi, my brother's PGWP has expired, and he also hasn't applied for a visitor record. He plans to apply for a study permit. Is there anyway possible that he can apply for an in-land study permit? Can we submit a restoration?

He doesn't meet any of the criteria to apply for a study permit from within Canada. He can apply to restore his status to visitor, however even if approved, this still will not allow him to apply for a study permit from within Canada.

If your work permit has already expired, you need to apply to restore your

  • status and
  • authorization to work
If you’re eligible for one, you can apply for a study permit at the same time. Our online application system will give you an application form for a study permit. If an officer approves your application, they will restore your status and authorization to work, and then process your study permit application.

What do they mean by “eligible” is it equivalent to what they say in “who can apply?”?

He would need to be able to restore back to a work permit. For example if he had a job offer from an employer in Canada and an approved LMIA.

The issue is he let his permit expire and is now out of status. He should have applied for a visitor record before his PGWP expired to maintain status. Then he could have applied inland for a study permit.

Now he is out of status and can only restore status back to worker with a job offer. He can leave Canada and apply outside Canada. Make sure he has PAL, funds and can justify taking another program when he already has with PGWP. Needs to show career and education progression with higher pay when her returns home. It will be difficult to be approved.

You may still be eligible for restoration if you continue to meet the initial requirements for your stay and have not failed to comply with other conditions imposed.

The key is initial requirements so that is worker. He waited too long and cannot restore status to visitor. If he had just applied for a visitor record before work permit expiry he would not be in this situation.

If he doesn't even have admission and PAL then should leave Canada and apply outland. No chance for September either.

Restoration won't help him. He needs to leave Canada to qualify to apply for a study permit.

No one's stopping you from applying for restoration. Apply for restoration as a visitor and then submit a second application for study permit. Know that both may be denied and each day you spend in Canada is overstay. ny work is illegal.

Your brother needs to really consider whether doing another degree will lead to additional benefit. He won’t qualify for PGWP again so how will attempting to study again get him closer to PR which is assume the goal? He is probably better off returning home to work on increasing his CRS score and improve his profile. Many in his situation will also be denied a study permit if it appears he is just attempting to delay returning home and is not a genuine student.
