I was a Canadian PR and stayed only for 18 months in Canada, then moved to USA for job opportunity. I know I did not maintain PR status, therefore, I went to Consulate to apply for tourist visa. Every time, I go to Canada, I am stopped at Canadian Border and then I have to explain that I did not maintain PR,therefore, I am travelling on tourist visa. It is still showing that I am a PR in their system. I am interested in coming back to Canada, but I don't know if I need to apply fresh PR or should I request to give me existing PR card (if still valid) so that I can move to Canada. Someone told me that I can request for PR on humanitarian ground, but then how should I do that? Please advise.

So given PR status never expires and can only be revoked or renounced then how did you get a visitor visa which should not be available to a PR ? Did you not declare this fact on the application ? The fact that you have been questioned at the border as a PR and supposedly have a visitor visa issued post becoming a PR should be a red flag to CBSa.

If you had not met the residency obligation on your last entry to Canada then generally CBSA could have started the process to revoke your PR status.

Moving to the US for work or financial reasons are not valid for an H&C application for not meeting residency..

When did you become a PR and when did you leave, do you still have a PR card ?. What is your status in the US are you a citizen, green card holder or just a work permit ?
