Hello all,
my German husband has applied for per res from outside of Canada. I am getting mixed replies on right and wrong. when he comes over in 4 weeks as a tourist can he then go for a open work permit while he is here for the 6 or so months? After the employer fills out a Labor market opinion of course. ( I heard he can not apply IF his application for Perm res is in process.....) I was told the work visa will bump all our paperwork on the Perm res. cant apply for 2 things at once sort of thing.
IS THIS TRUE???

If he find an employer and that employer is able to obtain an approved LMO, he can then apply for a CLOSED work permit that is tied to that specific employer. And yes - he can apply for a closed work permit if he has applied for PR.

If he had applied for PR from within Canada (inland), then he would have qualified for an open work permit once he receive first stage approval (first stage approval takes approximately 12 months). However since your husband applied from outside of Canada, this doesn't apply to him.
 
Thank you so very much. never heard of a closed work permit. What is the diff between closed and open?
 
An open work permit allows work for any employer where conditions are met (medical for one in certain areas); a closed permit allows for employment only with the employer listed on the work permit.
 
As an employer we had an LMO and 3 year work permit issued for one of our employees who is mid way through his spousal sponsorship to get a PR, there was no issue doing both, we received the LMO and the work permit and his sponsorship is still in process and he is actively working in Canada as we speak. So yes it is possible to do both. I would advise having a lawyer for this or using the employers lawyer and advising you also have a PR application in process.
