Partner's OWP rejected - Please help

    Hi all friends

    I have applied for my study permit and my partner's open work permit at the same time . However my partner's visa is refused today after 3 weeks ( Mine is still in progress) . The refusal letter is as follows :

    Thank you for your interest in working in Canada. After careful review of your work permit application and supporting documentation under the International Mobility Program, I have determined that your application does not meet the requirements of the Immigration and Refugee Protection Act (IRPA) and Immigration and Refugee Protection Regulations (IRPR). I am refusing your application on the following grounds:

    • You have not complied with our request for information, per subsection 16(1) of the IRPA. To date, you have failed to comply with our request for submission of the following documents:

    • I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 200(1) of the IRPR, based on your travel history.

    • I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 200(1) of the IRPR, based on your immigration status.

    • I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 200(1) of the IRPR, based on your family ties in Canada and in your country of residence.

    • I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 200(1) of the IRPR, based on the purpose of your visit.

    • I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 200(1) of the IRPR, based on your current employment situation.

    • I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 200(1) of the IRPR, based on your personal assets and financial status.

    You were not able to demonstrate that you will be able to adequately perform the work you seek.

    • The offer of employment is inconsistent with the terms of a federal-provincial agreement that applies to employers hiring foreign nationals


    I wonder what the first ground indicates ? What documents are missing ? We provided all the necessary documents and answered to all questions truthfully and we were never asked for additional documents. Why should the officer mention my partner's Immigration status ? He is a citizen of our country and have never over stayed in any country and has no immigration records in any other countries. All documents regarding his financial status, Job, bank statements and properties was provided. All this grounds of refusal convince me that either the officer didn't look at his documents at all (even his passport) or all the documents somehow disappeared from his file !!!

    Can anyone please tell me what is wrong here and what documents the first ground says is missing ?
     
  2. As I know... Your partner work permit will be issue based on your study permit. You need to get first your study permit and after that apply for a spousal work permit based on study permit. The work permit will be issue until your study permit expire date.

    Just wait for couple of more answer to see.
    However, as far as I know, the process is like that.
     
  3. You must have missed the email requesting additional information. Check your spam folder. That's usually where people find them.

    Are you both living and working in your home country at this time?

    What documents did you provide to show employment? What kind of job does he hold? How much money do you have in bank statemenets?
     
  4. I have checked my spam folder . Nothing is in my email and no requests in my CIC account ( I submitted online)
    We both live and work in our country and we applied from there , it is strange why they mentioned his immigration status.

    We provided his job letter as a sales manager stating his salary and mentioning that he can continue his work after his trip .

    His bank statement with a equivalent of 70000 CAD .

    Title deeds of his two properties (one apartment and one store) in our country was also provided.

    These are just proofs of his financial status . Lots of other supporting documents where also provided which I didn't mention here.
