Hey guys I have an issue with my visa status now. I was authorized school of leave for two months and I worked about a month while I was leaving from school.

My employer wants to apply LMIA and wants me to apply for the work permit now. In this case can I change my visa status with this record that I worked while I’m in leave of absence? Would it be possible to get approval from IRCC if I apply for work permit?

What was the reasons for your leave from School? Yes, if your employer submit documents proving that you were full time from the date you were granted leave from school, thats a problem!! It goes further if that contradicts reason for the school time off

If you’re on an authorized leave
If you’re on an authorized leave from your studies, or you’re switching schools and you’re not studying, you can’t work off campus. You can only return to work once you’re back to studying.

In short, you weren't supposed to work, if you don't declare it, might count as misrepresentation.

Impossible to know if your employer will get an LMIA and if you will get a WP. Have you returned to your full-time studies?

I worked just 20hrs per week but he wants to support LMIA to allow me to apply for work permit. It will be a problem to get permit then?

We cant say for certain, but odds are with your SP chances are not high for your employer to get LMIA. Mind clarify why did you take time off?

You need to stop working if you are not studying. Why were you given a leave of absence? Keeping on working illegally certainly doesn’t help. Even if you got a WP it will be many months. If you don’t return to your studies your study permit will get cancelled and you will be in Canada without status.

Your employer doesn’t decide ifhe/she gets an LMIA. They can apply but this is a long uncertain process. Employing you while you aren’t entitled to work doesn’t help your case.
