parents separated - cic asking for documents (help!)

I have applied for my mom's sponsorship in 2010. My step dad and mom lives separately. They don't have any children and they don't talk to each other. He is living in Dubai and my mom is currently in Canada with me on Supervisa. They have been separated since 2009 and he is already married to another women..

when my mom asked for official divorce; he doesn't want to cooperate. he said he doesn't care.

I selected legally separated in the application and cic is asking:

"you indicate that you are separated from your spouse. If yours is a legal separation, please provide official documentation confirming this. If it is not a legal separation, there will still be a requirement for your spouse to be examined. If this is not possible, you are required to show attempts that you have made to contact him to request that he be examined"

what are my options? since he has changed his phone number and email address.. no way for us to contact him..

any help would be appreciated.

I guess affidavit from lawyer may be the only choice at this point..

Agreed. The divorce doesn't have to be finalized. She just has to demonstrate that she has started the divorce process.

They're legally separated since they have been living apart for more than a year.

If there's a printout of an email communication with him about the separation is also helpful.

A sworn affidavit is helpful.

I think they just want some paper trail for their record.

Legally separated means a court order also and not just a mutual understanding.

The best option is to file immediately for a divorce and once the case is filed, furnish a copy to cic.

Agreed with all of the above. We've consistently seen CIC ask for formal paperwork for those legally separated.

my husband will sponsor his mom. his parents have been separated since he was a child but there is no legal documents (philippines). can she put separated in her application form or will this be a problem?
