Hello All,

Can I appeal if the application for PR for my parents were refused ? I am the sponsor. I applied outland.

If I can, what is the process to appeal ? Is it a must that I contact a lawyer for this process ?

Any help is appreciated.
 
What was the reason for refusal?
 
Non disclosure of correct information to question 9 on Schedule 1 in the application..it has been refused on the grounds that the information was misrepresented \ withholding of material facts. It was an oversight on part of my parents, and we sent a letter to the embassy explaning the oversight. However the application was still refused.
 
do u mind giving more detail, as I am in a situation with the same question on schedule 1. We answered no to whether or not he had asked and been refuse for a visa. It was a mistake as we misread the application. I was just told to either re-submit that portion of the app or write a letter to correct and explain. Hearing abt denials scares me. Also at the time of the visa, we werent sure if we were going to get married and had never met, so we didnt disclose our relationship. But when it was refused I travelled to see him and a month later we had a big wedding with his family. So now Im super worried abt this misrepresentation crap.
 
You do have the right of appeal to the IAD for the refusal. It's up to you whether or not you want to hire an immigration consultant or lawyer to represent you but you don't have to. If you feel capable of handling it and understand the legal language and procedures, you can certainly do it yourself.

There are several questions associated with Section 9 of the Schedule 1. Some have much bigger implications than others.
 
This is true, one just worries how an official will look at things and see them.
I know many people dont say they are meeting a gf/ bf or whatever the case, but things come back to haunt sometimes. The time spent waiting begins to make u paranoid.

On the otherside, best of luck with the appeal. Its difficult whether it is spouse or parents one is seperated from.
