Parents applying for PR with a 20 year old daughter.

Hi all,

I am an employed electrician in Alberta for the past 18 months, I have the opportunity to apply under the AINP program for my PR. This is were the problem comes, I have a 20 year old daughter who came over to Canada with us. The age has since been changed to under 19. I have spoken to a lawyer and it seems like there are not too many options open to us to keep her with us as a family. She could go into a study program but at international rates its just not affordable. If there is anyone out there that has some info on this subject please let me know. It is just not an option to send her home on her own.

Unfortunately right now, there is nothing you can do as she doesn't qualify as a dependent. The only thing she can do for now is remain in Canada as a visitor, with a work permit, or on a study permit.

However, the Liberals made a promise in their election campaign that they would increase the age of dependents back to the original amount of under age 22. So if they are really aggressive in pushing through their immigration changes this year, it could happen in the near future. But then again it may get delayed for several years... really nobody knows what the timing will be.

As long as they make the change before your daughter's 22nd birthday, then you could either add her to your AINP PR app and all get PR together, or if you're a PR at that point you can sponsor her as a dependent under family class.

Worst case of course is they don't raise the age until after her 22nd birthday (or decide not to raise it at all), at which point it will be too late. You have a few years though, so hopefully they make the change sooner rather than later.
