Hello, My spouse overstayed in Canada, during which time we applied for TRP. He voluntarily left Canada, and we were re-evaluating our relationship. I received iTA and i was approved. He was examined, provided police clearance and medicals, and is included as a non-accompanying spouse on my ecopr. We are back together, and this break has actually helped our relationship as well. I would like to know if i should request humanitarian grounds for this PR or just normally do a sponsorship. His trp that was submitted in 2025 jan is still being processed.

H&C is if he is in Canada and how is he eligible so no. He has applied for PR and TRP so nothing more to do.

It's a regular spousal sponsorship application.

Thank you! We call each other everyday and text as well. I am planning to visit him next year. His TRP has a temporary number. He left Canada, when I got the ITA. I am worried that his overstay will result in refusal

I don't think one impacts the other. You can always check with a lawyer.

I have previously reached out to lawyer on overstay issues and they said he could stay in Canada while I submit PR. When I talked abt this, they said humanitarian grounds are needed and I ca provide psychological assessment documents and stuff regarding my depression to support it

But your spouse is not in Canada to file H&C.

You know that H&C cases are over 10 years now. Why not go through regular route with TRP approved? Probably faster.

TRP can take time. The application that was mailed out on Jan 2025, only received AOR in October. The likelihood of approval is also very slim.
